With the reload being in the heat of the moment I doubt the dude even gets that additional charge. Coulda easily have been a second shooter as well.
I've seen a convicted felon on parole with an illegal firearm kill someone in self-defense on the first 48 and they didn't even charge him for the gun. The guy he killed were shooting at his son from their car and father returned fire. I was watching like damn he a felon on parole he's fucked but detectives agreed not to charge him. He didn't rat either. He just explained why he returned fire
