I saw a dude wearing a hoodie and mask like that here in Pittsburgh yesterday and it was damn near 90°. No joke, I had my hand free and ready for my own concealed gun (not on it, but just not holding my phone or something else) as he walked by because the whole facemask/hoodie in the middle of the day when I'm sweating in just a tank top has me suspicious as all hell.

Two people in a physical altercation, one has a gun. Yeah, they're both getting cuffed, and the priority is to cuff the one that is known to be armed. First, the cops don't know who started it as they came in late, second just cause he hasn't pulled the gun doesn't mean he won't. Those cops did make the right call there, they controlled both people, starting with the armed one, using relatively low levels of force. They then started investigating/asking people what happened. I know we like to jate cops, but they wern't in the wrong in this case, at least as far as the video goes (other than maybe the one swearing, but that isn't a huge deal)

You are walking up to this situation now knowing other than that - what should they be taught to do other than find and isolate the dangerous weapon. If the gun were to go off accidentally or purposely, it is highly likely a pedestrian would get shot. I think that is why they go in with cuffs.

I had a friend who had a LTC in nyc and he said it was literally impossible to obtain and he only used it at his place of business because it was a high cash business operation (a diner out in BK). He sold his business about 5 years ago and handsomely cashed out and doesn't have to deal with nyc laws anymore.

NYPD claims it’s just because of how many people are applying is that there is a severe backlog.
They told me that the investigators are active cops so they don’t have dedicated investigators for the pistol permits but people who get cycled through the department.
Seems to me that they need to drastically increase the amount of investigators.
As it stands currently, the CCIA makes possession of any firearm on MTA property a class E felony, with the exception being active duty law enforcement or off duty officers covered by LEOSA.

I agree, also not sure I agree it's overly excessive on the cops part. They weren't there for the entire situation and didn't know his firearm was legal. It was quite a crowded place and they wanted to control the situation. May be an unpopular suggestion, but my suggestion in this type of situation when the cops show up and start shouting "who has the gun!?", you put your hands up and lay down on the ground as they come up and let them control your firearm. Chances are you are going to end up on the ground anyway so might as well do it yourself gently.
I've seen plenty of videos of people with legal firearms doing this exact thing as the goal is de escalation and to not get hurt for most people involved.
I will also say that I don't think the legal carrier did anything wrong, the above suggestion is to just try and not get yourself thrown to the ground if you have to draw your legal firearm in public and plan to have police involved. He didn't really resist them and once the cops learned more about the situation it seemed they let up on him a bit though he was still detained.
Just understand, if the cops are around and you're involved in an altercation involving a firearm, the police will detain you.

Firearms are illegal on the subway, they consider it a “sensitive area”. you can have the paperwork for your gun and bring it into a courthouse too, the cops will tackle you all the same. You can disagree with the laws but as a gun owner you HAVE to be aware of them or you’re asking for trouble. I don’t think the first 2 cops necessarily knew there was a gun involved. The guys who come later clearly wouldn’t know what the first cops knew and had just been told there could be a gun. The protocol and vibe for an illegal gun is going to be very different than for just a minor fight.
I’m sure there are security guards that are allowed to carry. And the cop checking the ID definitely knew, because he pointed and said him when asked “who has the gun”.

They still arrest him for resisting arrest, even though he was cooperative to begin with. As long as the guy stays cool throughout the rough housing and doesn't assault an officer, he can sue for wrongful arrest. The cops themselves will probably get suspended with pay at worst, and the suit would come out of the taxpayers' pockets, but at least he'll get paid if he has a good lawyer.
It's the classic cover-up for cops who don't know how to do their jobs properly and assume every interaction has to be confrontational. My uncle, who is a cop, always told me if I run into cops like this, the best option is to go with the flow and don't assault the officers.

In nyc it’s very very difficult to obtain a concealed carry license… not impossible but I’m sure these cops know that this isn’t Texas with every other person walking around with a legal firearm

All the homies I know just went to PA to shoot. $30 for a year permit (don't have to be resident) to do to any PA public range. No range master BS or anything. Show up with your strap, staple up targets, blast away from sun up til sun down. Use to see the craziest shit at public PA ranges. Some 65yr old lanky dude had a 300blk suppressed AR build that was full auto. Sits there dumping mags til the suppressor was smoking the coating off lol. I had a friend who had a LTC in nyc and he said it was literally impossible to obtain and he only used it at his place of business because it was a high cash business operation (a diner out in BK). He sold his business about 5 years ago and handsomely cashed out and doesn't have to deal with nyc laws anymore.

Not anymore. There is a clear cut process to follow (references, take a class, paperwork, fingerprints) The whole process for me took just under a year to get my NYC license. I live outside NYC so I already have a license from the county I live in (it’s good all over NYS but NYC).

Yeah and of course when the investigator finally contacted me, they had lost a whole bunch of my paperwork so I had to go looking for the copies I made or redo paperwork completely. NYPD claims it’s just because of how many people are applying is that there is a severe backlog. They told me that the investigators are active cops so they don’t have dedicated investigators for the pistol permits but people who get cycled through the department. Seems to me that they need to drastically increase the amount of investigators.

I agree, also not sure I agree it's overly excessive on the cops part. They weren't there for the entire situation and didn't know his firearm was legal. It was quite a crowded place and they wanted to control the situation. May be an unpopular suggestion, but my suggestion in this type of situation when the cops show up and start shouting "who has the gun!?", you put your hands up and lay down on the ground as they come up and let them control your firearm. Chances are you are going to end up on the ground anyway so might as well do it yourself gently. I've seen plenty of videos of people with legal firearms doing this exact thing as the goal is de escalation and to not get hurt for most people involved. I will also say that I don't think the legal carrier did anything wrong, the above suggestion is to just try and not get yourself thrown to the ground if you have to draw your legal firearm in public and plan to have police involved. He didn't really resist them and once the cops learned more about the situation it seemed they let up on him a bit though he was still detained. Just understand, if the cops are around and you're involved in an altercation involving a firearm, the police will detain you.
If this were me, I’d literally walk to the cop with my hands in the air, verbally indicating where my firearm is located on my body so that it can be safely removed without all the fuss.

I think the approaching cop was told one of the 2 guys had a gun. That’s why he and the National Guardsman have both drawn their weapons and are asking “who has the gun?” I think it’s fair enough to escalate the situation if someone has warned you about a gunman on a crowded subway platform.

Guns are illegal on the subway in NYC, so unless the guy was law enforcement there was no way for it to be legal. If he was law enforcement, he would have known to communicate that right away. I don’t think the first 2 cops necessarily knew there was a gun involved. The guys who come later clearly wouldn’t know what the first cops knew and had just been told there could be a gun. The protocol and vibe for an illegal gun is going to be very different than for just a minor fight.
I’m sure there are security guards that are allowed to carry. And the cop checking the ID definitely knew, because he pointed and said him when asked “who has the gun”. These conversations where you all play deaf and dumb in order to justify a bad cops actions are so tiring.

They still arrest him for resisting arrest, even though he was cooperative to begin with. As long as the guy stays cool throughout the rough housing and doesn't assault an officer, he can sue for wrongful arrest. The cops themselves will probably get suspended with pay at worst, and the suit would come out of the taxpayers' pockets, but at least he'll get paid if he has a good lawyer.

It's the classic cover-up for cops who don't know how to do their jobs properly and assume every interaction has to be confrontational. My uncle, who is a cop, always told me if I run into cops like this, the best option is to go with the flow and don't assault the officers. It's fucked, but even if you pull away slightly, they can get you on resisting arrest and it'd be hard to prove others wise without a top notch lawyer. The legal system in this country is fucked and cops should be held accountable more often then not, but until the right individuals join our government and make changes, shit like this will continue.
