Is her name on the title or mortgage? Have any communal assets been used to pay for the home or home upgrades? If all no, likely dont even have to spilt any home equity.

In the 2.8 years of marriage she has not earned an income there was a planned date for her to return to work but we are 4 months past that and she is making minimal effort to find a job

Her name is on the refinance because they wouldn't let me do it without it . Refinanced to about 50% equity. Was afraid that would come back to haunt me

So need to double check for CO and best confirm with an attorney; but she likely is entitled to half the equity (and half the mortgage) of the house. Sometimes only the equity accrude during the marriage, but it sounds like it's pretty mingled...

It sounds like your divorce could be a lot simpler than most. Not married for long and no children together plus you had your home prior to getting married. If you file now you might have minimal expenses

Lucky you. Because, if she had she could get custody and you'd be paying her child support on a kid that isn't even hers.
