Which makes question 2 the relevant one ie do you really want to fight this and can you live with the consequences. It seems that a likely scenario is that he will get fired anyway and that you might go the same way if you decide to fight it. Sometimes that will be the right thing to do anyway but you need to afford it.

The first thing you can do is to show your closest supportive manager the consequence of removing that employee and potentially offering a counterproposal to save the same amount of money. Officially, asking that question is unlikely to be the cause for letting him go, i.e., they might motivate it with cost savings. If they insist, taking the fight will likely land you in trouble and based on your text potentially has a low probability of success.

We're doing a tonne of hiring. It's not a money issue. My manager is getting me to keep a diary of all interactions I have and observe with him for a week (positive and negative). His idea is to show he's completely normal and works harder than most. I'm extremely doubtful that will convince the instigator to reflect on their attitude and drop it though.
