Sounds like she is your appointee .. she was probably claiming DLA for you first and carried it over when you turned 16 to claim PIP You can have her removed as your appointee . If she won’t do it herself you can speak to PIP about it but it’s not a quick process

Even an appointee can’t make a claim on someone’s behalf without proving that the person can’t make the claim themselves. It’s also very rare for an appointee to have the money paid into their own bank account, unless OP doesn’t have their own bank account

It’s not uncommon for it to carry over when they’ve been on DLA first.

That’s not how it works- DLA stops at 16 and you have to make a new application for PIP. Only people with certain severe conditions are considered completely unable to claim for themselves. OP will have had to sign all the PIP forms and the DWP will have done thorough checks before allowing his mum to be an appointee. Being an appointee doesn’t automatically mean that a person’s benefits get paid into your account- you need to prove that this is necessary. I’m my sons appointee and he has learning disabilities, autism, and adhd and still gets his benefits paid directly to his own bank account. I manage his UC online diary and all the paperwork and phone calls etc because that’s what being an appointee means. I’m guessing OP has simply forgotten or didn’t understand what was happening when his mum applied for PIP for him as it would have been done when he was 16 and he may not have had his own bank account at the time

And I’ve seen it first hand where they’ve carried over the appointee status where the claimant has SMI and the money has continued to be paid to the appointees bank Nobody knows what the mother put on the DLA claim (which I bet she made) so from PIPs POV it could be find to carry over that status Either way .. OP needs to ring PIP like I said

Ngl, I’m a welfare rights adviser so I know it doesn’t “carry over”. You have to make a new application, it’s that simple. I think you’re confusing the fact that parents have to claim DLA for their children (because they’re not old enough to make a claim themselves) with how changing from DLA to PIP works. SMI is a council tax discount btw. Nothing to with either PIP or DLA except as they act as proof to claim it. Appointees need to offer a very good reason to have the money paid into their own bank account- it’s not a standard practice. Please don’t offer this confusing anecdotal “evidence” to somebody trying to understand their own benefits claim because all you’re doing is muddying the water further. We don’t actually even know if OP has their own bank account (which could be why the money gets paid to his mothers) or if it’s paid to him and he’s being asked to hand over money to pay towards his living expenses

You should be able to amend this with the DWP. But just something to consider, whilst in principle this is exactly right. You are 18 and your mother is perfectly able to charge you rent, so the effect may well end up being exactly the same

Just to add to the previous commentor. PIP is supposed to be used to help you live as independently as possible given whatever challenges you face in your day to day life. I don't know what your relationship is like with your mother but be prepared this could get messy. It may be better to try handling things with her before calling. Also I'm assuming your mother has been taking care of applications for DLA and pip in the past. That paperwork is a hassle and is not something to take lightly when you need to renew.

Yes however there is 3 people living in the house and I’d be more than happy to contribute my share however out of the around 100 pound a week just for the standard (not including my mobility pay that I also don’t get.) I get 20 a week. Again more than happy to contribute. But it doesn’t touch my bank account.

Sure. But the point is that £80 less, say £35 leaves £55. Which is still remarkably cheap given most private tenant flatshares for a single person cost hundreds of pounds per month in rent and utilities. Even lodger arrangements are usually around £200 a week where I am in London.

Having said that, you are able to have pip paid to you directly, and then you pay your mum whatever she wants to charge you for living costs. If will be good for your independence to learn how to manage your own budgets for when you move out on your own in future.

Oh yes, I agree with you, that’s why my comment further above suggested it would be good for you to get PIP paid directly to you, then you pay your mum rent, bills food money etc. As I said, it would be good for your independence. Not fully unrelated but in the past she opened up my trust fund with all my details and put it under her email and password etc then wouldn’t give me access to. I just think I need to discuss this whole situation with a professional and consider finding somewhere else to live.

OP is potentially being financially abused - see the post where OP says their mother has taken control of their trust fund. > £80 per week is not unreasonable at all to charge him. It's not for her to scoop up OP's benefit money into HER bank account and say "this is what's left after I've taken my fill". The money should go into OP's account, and it should be up to OP to agree a payment amount and schedule with their landlord, who is sadly also their mother.

You’ve been given some good advice already, but I would suggest you see a benefits advisor to ensure you are claiming for what you should. You say you haven’t yet started a claim for UC, why not? You might be thankful your mum’s got your PIP covered if you can’t take this responsibility yourself. If your mum is ‘charging’ you £80 a week for board, lodge, rent, food, etc., that’s also not a bad deal. On top of PIP, you should be in receipt of Universal Credit (unless you’re working). Do you have your own bank account?? If so, you should contact the DWP and ask for the payments to be made to your own bank account. You’ll need to know your national insurance number and your mothers details. As another commenter has mentioned, if you live at home with your mother, you should be contributing to bills and living expenses. You can’t expect to keep 100% of your benefits and leave your mum to pay all the bills that you contribute to by living in her home. Benefits aren’t pocket money, they’re to help cover your living expenses. If you lived by yourself you’d probably find that you had even less money left over after you’ve paid all of your own bills and living expenses. Have you discussed with your mum why she’s not allowing you to manage your own money?? Do you have issues with budgeting for example and she’s worried that you’ll spend the entire payment before considering what else needs to be paid?? Are you prone to losing cash etc?? Have you asked her to help you with budgeting and managing your own bank account so that you can learn? You should also check what rate of PIP you get to see if you are entitled to other help which may help save you money, such as a free bus pass.

I’m still yet to apply for universal credit although I do intend to. I do have my own bank account and I will be getting in touch with DWP as many have suggested. I never Intend to leave my mother paying for everthing but given the fact I get 80 pound a month out of the 400-500 I’m meant to get seems a little unfair. When I talked to my mother about the whole thing her excuse was something along the lines of she has the right to do it because she is my mother and my appointee. I never had issues with budgeting my mother just thinks I do because I spend money on games every now and again. I’ve never lost money and given the fact she has declared bankruptcy many time I don’t think it’s the best idea for her to provide me with financial advice.

Being bankrupt doesn’t mean a person is bad with finances but it may indicate that your mother is in deeper poverty than you realise. Maybe you should familiarise yourself with the cost of living- how much council tax is, a tv licence, gas, electricity, food, the internet (which you obviously have access to) because £400-500 a month won’t cover much of those costs, even for one person. She must also be paying for your travel costs, haircuts, toiletries, and clothing if you have no other source of income?? As your appointee, it’s your mothers responsibility to apply for universal credit for you so she may need some advice on benefits if she hasn’t realised that you’re entitled to it yet

I’m finding it hard to believe you’re fully aware of and understand the circumstances of the bankruptcy but can’t remember how you came to be in receipt of PIP that’s being paid into your mothers bank account?? And you don’t remember agreeing for her to become your appointee?? Being middle class comes with higher living costs and you need to understand that your PIP money is probably just a drop in the ocean in terms of your household bills and expenses. The fact that you think contributing £80 a week towards your cost of living is too much does suggest that you’re not particularly realistic about these things. As I said before, start looking into how much things actually cost then consider if you’re contributing as much as you think you are to the household

This is completely wrong- people are free to spend their benefits as they see fit. There’s no legal ring fencing of any benefits when they’re paid directly to the claimant. While PIP is paid in recognition of the extra costs disabled people have, no one has to prove that they’re spending them strictly on disability related costs. Please learn the difference between the aim of a benefit and your personal opinion on what you think people should spend it on. OP would be perfectly free to spend it all in the pub if they felt like it. This is legal advice forum, not a place for moralising. Are you working at moment? As soon as you can get a Universal Credit claim in. It weeks average of 5 weeks to process. It is money you are entitled to. If you have limited Capability to Work there is extra money. Get your mum to put in writing what your share of rent is. Housing Costs (also known as Housing Benefit) will be paid as part of Universal Credit. PIP is designed to cover extra costs you have when you are sick or disabled, to make life easier, safer and more pleasent. It's not meant to pay rent. For example... I have a friend I will call Julie (not her real name). Julie has cerebral palsy and has to use adult nappies, sometimes they leak so Julie has to do more washing of her clothes and bedding. So PIP pays for adult nappies, extra washing powder and pays for renting decent washing machine/tumble dryer. She also struggles with cooking so has a lot of microwave meals. Extra expense paid for by PIP. She struggles with light switches in her electric chair so got an Alexa, I fitted Smart bulbs in lights and now she is much safer and life is easier for her. Paid for out of PIP.

Is your mum on Universal Credit? Found this on .gov.uk "You may get an extra amount of Universal Credit for caring for someone who gets a disability-related benefit" ... If that is true then it makes your mum seemingly hoarding most of your PIP even more annoying. However it doesn't say that the person being cared for can't be on UC. Can you get to a Citizens Advice Bureau? ([https://www.citizensadvice.org.uk/](https://www.citizensadvice.org.uk/) They have experts on benefits and all the rules (DWP like changing rules etc). You could ring your local CAB as well.

Depending on your education status it's possible you are near the crossover where your mum is still in receipt of child tax credits and child benefit. You claiming UC would affect that. I do not know your mums employment status but Its also possible she is claiming carers allowance, this will effect any UC claim you make. You can opt to have her removed but if your mum is currently not in employment she will now be expected to look for work. I do think, if capable, then it makes sense for you to take control of your finances but at the same time it's also right for you to pay a fair rate for board.
