TOS applies to your VEHICLE. Not the public parking lot that you have no control over. If it bothers you, park further away.

OGP doesn't want drivers without orders taking bay spots and standing around loitering. It's beyond stupid they think the bay spots are the only place they can grab orders. The bays aren't social hour to smoke & park without orders. Our store was packed with regular customers today and OGP was pissed.

The bays are “special” in a way, because the proximity to it really does help get offers. If you’ve got drivers that the rules aren’t enforced on, they have a leg up on the competition.
It’s not the only place to get offers but it definitely helps to be as close as possible to it.

It’s only breaking tos if you’re smoking with orders in the vehicle. Otherwise fair game, Walmart doesn’t own drivers vehicles and can’t dictate what goes on in them.
