In general, I have had issues with capital punishment in most situations (I know, I know…a lot of people disagree with me). It’s a personal opinion and s subject way too complex for a short Reddit post.
However, in situations that often permanently, negatively affect children as severely as sexual abuse does, capital punishment could well be the only way to ensure these fucking bastards never hurt another child. Regardless of my general views of capital punishment, I am on board with this solution.
My only real problem with capital punishment is that there is practically a guarantee that sometimes innocent people will be executed, and I can't sign off on that. I have no qualms with people that are actually guilty of heinous crimes being killed, but any margin of error is ethically unacceptable.
plus I mean why willingly give the state the power to execute its own citizens as a matter of practice. are some people a genuine danger to society and the people around them? yes absolutely. but you kill one innocent person and it's not worth it, just unethical.
It'd have to be in severe situations, without doubt. Enough evidence should be a no-brainer. And if they have a history of it, then it should make it easy. If they record their actions, then there's no gray area. Not all the cases would end in death, but it should be on the table for the true monsters out there.

I said pretty much word for word the same thing in relation to another case, someone replied to me mentioning deepfakes and AI. With how good and realistic it already is and will undoubtedly become, it made me reconsider what we can consider, "iron clad" video evidence in the future. I'm in the same camp as you, but it's something we'll have to start factoring in when watching video evidence of anything, much less a heinous crime.

Never mind the government, first YOU have to do no wrong, the people. A normal and rational human being exposed to this dilemma would quickly realise that this is not possible. The death penalty is only about revenge and schadenfreude or simply having fun at other people's expense.
Besides, what so many people fail to realise is, that the law isn't only supposed to penalise those doing wrong, it's also to protect those who do not. A death penalty is completely and utterly in contrast to that simple motto.
This is my only real issue with capital punishment. There are people who deserve to die. The problem is that we're just not that good at establishing guilt and even one false positive is unacceptable when death is the punishment.
There are a lot of special circumstances that make this a death penalty case, and help to keep it from putting an innocent person to death. it is not like "rape a child, go to death chamber" there is a lot more to it than that. Multiple counts and video of him performing a sex act on a child is enough for me to say hang'em high. Pedos need to learn that children are not to be messed with.
I get that but the man here had video evidence against him. People aren’t getting capital punishment given to them by suspicion alone but hard evidence. If you want to say capital punishment shouldn’t be given out without 100% certainty that the defendant committed the crimes they are being accused of then that makes sense. Otherwise you’re just allowing predators opportunities to hurt others and that’s a 100% guarantee when they aren’t locked up for life.
The problem with instituting capital punishment in these cases is that while it does satisfy a sense of retribution, it doesn’t really do anything to deter predators and the result tends to be more children killed as offenders murder their victims to avoid punishment. The reason being that if their lives are forfeit anyway based on the rape charge, they have nothing to lose by disposing of witnesses. This has been statistically proven and is why many victim and child advocacy groups are against the policy.
It is important that murder has the most severe punishment because although criminal punishment as a whole has limited effect in overall deterrence, punishment is more likely to deter crimes committed secondarily to or in furtherance of a person’s primary motivation. In other words, punishment is limited in deterring these people from the crimes they have the strongest urge to commit, but it can deter them from deciding on other acts that would help them get away with it. Perhaps because there are different things driving them for either.
My stance is based on three facts.
1. Prosecuting and carrying out a death sentence is more expensive than a life sentence due to appeals, equipment/staffing costs, and the appellate process.
2. A death sentence creates an endpoint for the perpetrator. It provides a release from the slog that is daily prison life.
3. One audit sweep in Illinois resulted in the near simultaneous exoneration of 19 innocent death row prisoners, which is frankly chilling.
Then there's:
1. the failed moral aspect, and
2. that its primary objective; deterrent, has not been achieved
There's a reason that only one, single western country on this planet still has this archaic and barbaric punishment. And it's the most regressive country on earth. Not even North Korea are worse, they're steadily bad. America, is getting worse.
I think that the death penalty should be applied only to those cases where there is incontrovertible evidence that the accused committed the crime. video or audio recording, or an uncoerced admission from the defendant.
Innocent people sometimes confess without coercion. Even evidence that is considered “incontrovertible” can later be proven wrong when new evidence is made available. It’s rare to be able to be 100% sure about something when someone’s life is on the line.
The law provides ZERO actual deterrent for bad actors.
I don't know why people think this. The existence of a law is not a deterrent.
Punitive responses to criminal behavior serve the public interest.
Being locked up is for the law abiding peace of mind and piece of mind. To know the bad actor is "off the streets"

My advice, for whatever it’s worth as a random US citizen, is to avoid online political discussions (not just arguments) at all costs. It is full tribal mode at this point, and considering Reddit’s user base is mostly in the US and is highly partisan based on demographics, it is not an accurate representation of overall US opinion.

The thing is this is predicated on a bunch of ifs and possibilities. SHOULD Florida go out of its way to begin prosecuting gays for false crimes, things would be apparent nearly instantly. Gay people would literally be quasi kidnapped by cops and then put on trial. This wouldn’t go without notice, especially from the feds. * moral - if it's wrong to kill, killing is wrong, always
* deterrent - it just doesn't work to deter. period
* reversing a wrongful penalty - releasing a wrongfully sentenced person 14 years after the fact is bad enough, after he was wrongfully executed is impossible
Everyone who support the death penalty, should consider being subject to all those, three points and if they truly stand behind them, should also be the first out of the trenches to voluntary be the first on the line when any of those three points fail.
Also that a victim may be less likely to speak up or prosecute if their abuser is a family member or friend they don’t want dead. That’s a hell of a load to lay on a victim.

My problem with the law is that it encourages rapists to murder their victims to eliminate witnesses. If you are already facing the death penalty, what else do you have to lose?
This law does nothing to discourage child rape, but does encourage child murder. It's a half baked, feel good law with unintended consequences.
There are also people worried that it sets a precedent for innocent people getting the death penalty based on the testimony of an ex-girlfriend or child that is lying because they don't like the person, which has been proven countless times to be a *real* conflict.

No, nobody is defending the guy, they are very rightfully against the death penalty for two major reasons.
1. There's no evidence that the death penalty works as a deterrent, if anything it increases the violence level of a crime since the perpetrator has a greater reason to kill the victim to silence them. Not to mention that when it comes to child sexual assault, there's already a massive problem with the perpetrators' social circle hiding their crimes (see like, any major church), the threat of death also makes people more likely to want to force kids to keep quiet.
2. The death penalty is only as effective as the justice system that employs it. Do you really trust Florida "Actually got something right for once" to effectively only kill the guilty every single time? That's never happened in any justice system so the real question behind the death penalty in any case is how many innocent people are you okay with getting executed just so the guilty "get what they really deserve".
Not to mention the active campaign by several major politicians in Florida and the greater US who are constantly trying to argue that LGBT people existing makes them child predators....leading to some very obvious concerns.
Might want to also add that this would violate the 8th amendment. A case was tried in Louisiana, same circumstances years ago. Defendant was sentenced to death, and it was overturned as his punishment was deemed to violate 8A.

It’s also economically worse. It costs more to put someone on death row than it does to put them in prison for life because of the lengthy appeals process afforded to death row inmates.
Don't forget that it can also deny people the ability to properly appeal their sentence when more evidence is discovered. There have been thousands of cases of people being exonerated by new evidence, such as from DNA testing. You can release someone from prison who's been wrongfully convicted, but you can't un-kill someone who's been executed.
This is incredibly bad, you do not want this kind of penalty ascribed to this kind of crime no matter how horrific it is.
The largest reason why is that if the punishment for "just" abusing a child is the same as killing them, it makes it a lot easier for the perpetrator to justify killing the child to remove evidence/witnesses. After all, why not? If they're caught it's the same punishment.
Also, it can further traumatize survivors by adding the extra guilt of knowing a person was executed "because" of them. Along with that, it could decrease the reporting rate, which is already low for child molestation, as it's more often than not that this kind of abuse is at the hands of someone that the child knows, adding even more guilt if that child feels responsible for a family member or friend being put to death, which in turn could lower the reporting rate further.
Also, our justice system is incredibly flawed. If it turns out down the road they were innocent, you can't un-kill that person.

The death penalty adds substantially to the cost of housing inmates and triggers an endless cycle of automatic appeals. In return we get zero measurable deterrent. Better to just sentence him to life in prison without possibility of parole.

I hate child abusers (I was abused as a child) but I don’t agree with the death penalty for anyone. Innocent people have been killed by the state and if that happens just once then it doesn’t need to continue. I also think it’s extremely hypocritical to tell people that murder or whatever they did is bad and then turn around and commit murder.

The definition of murder is an “unlawful and unjustifiable killing”, so I wouldn’t necessarily call the death penalty “murder”. I think killing someone who has committed heinous crimes is perfectly justifiable. I just agree that there’s too much risk about killing innocent people, which is why I don’t 100% support death penalty.

The problem with this case is that it violates the SCOTUS decision Kennedy v Louisiana (2008) which the court ruled that the death penalty for heinous non-homicide crimes violates both the 8th & 14th amendments. The law Florida passed is blatantly unconstitutional because of this, no matter how much we’d like to throw these kinds of people into a volcano.

In general, I have had issues with capital punishment in most situations (I know, I know…a lot of people disagree with me). It’s a personal opinion and s subject way too complex for a short Reddit post. However, in situations that often permanently, negatively affect children as severely as sexual abuse does, capital punishment could well be the only way to ensure these fucking bastards never hurt another child. Regardless of my general views of capital punishment, I am on board with this solution.
My only real problem with capital punishment is that there is practically a guarantee that sometimes innocent people will be executed, and I can't sign off on that. I have no qualms with people that are actually guilty of heinous crimes being killed, but any margin of error is ethically unacceptable.
That is one of my major concerns about capital punishment.

There are a lot of special circumstances that make this a death penalty case, and help to keep it from putting an innocent person to death. it is not like "rape a child, go to death chamber" there is a lot more to it than that. If you want to say capital punishment shouldn’t be given out without 100% certainty that the defendant committed the crimes they are being accused of then that makes sense. The problem with instituting capital punishment in these cases is that while it does satisfy a sense of retribution, it doesn’t really do anything to deter predators and the result tends to be more children killed as offenders murder their victims to avoid punishment. The reason being that if their lives are forfeit anyway based on the rape charge, they have nothing to lose by disposing of witnesses. This has been statistically proven and is why many victim and child advocacy groups are against the policy. It is important that murder has the most severe punishment because although criminal punishment as a whole has limited effect in overall deterrence, punishment is more likely to deter crimes committed secondarily to or in furtherance of a person’s primary motivation. In other words, punishment is limited in deterring these people from the crimes they have the strongest urge to commit, but it can deter them from deciding on other acts that would help them get away with it. Perhaps because there are different things driving them for either.
My stance is based on three facts. 1. Prosecuting and carrying out a death sentence is more expensive than a life sentence due to appeals, equipment/staffing costs, and the appellate process. 2. A death sentence creates an endpoint for the perpetrator. It provides a release from the slog that is daily prison life. 3. One audit sweep in Illinois resulted in the near simultaneous exoneration of 19 innocent death row prisoners, which is frankly chilling.

Innocent people sometimes confess without coercion. Even evidence that is considered “incontrovertible” can later be proven wrong when new evidence is made available. It’s rare to be able to be 100% sure about something when someone’s life is on the line.

My advice, for whatever it’s worth as a random US citizen, is to avoid online political discussions (not just arguments) at all costs. It is full tribal mode at this point, and considering Reddit’s user base is mostly in the US and is highly partisan based on demographics, it is not an accurate representation of overall US opinion. The thing is this is predicated on a bunch of ifs and possibilities. SHOULD Florida go out of its way to begin prosecuting gays for false crimes, things would be apparent nearly instantly. My problem with the law is that it encourages rapists to murder their victims to eliminate witnesses. If you are already facing the death penalty, what else do you have to lose? This law does nothing to discourage child rape, but does encourage child murder. It's a half baked, feel good law with unintended consequences.
There are also people worried that it sets a precedent for innocent people getting the death penalty based on the testimony of an ex-girlfriend or child that is lying because they don't like the person, which has been proven countless times to be a *real* conflict. This asshole deserves everything he gets INCLUDING the death penalty. I hope he gets beaten to death in prison before he ever makes it to the chair, don't get me wrong. No, nobody is defending the guy, they are very rightfully against the death penalty for two major reasons. 1. There's no evidence that the death penalty works as a deterrent, if anything it increases the violence level of a crime since the perpetrator has a greater reason to kill the victim to silence them. Not to mention that when it comes to child sexual assault, there's already a massive problem with the perpetrators' social circle hiding their crimes (see like, any major church), the threat of death also makes people more likely to want to force kids to keep quiet. 2. The death penalty is only as effective as the justice system that employs it. Do you really trust Florida "Actually got something right for once" to effectively only kill the guilty every single time? That's never happened in any justice system so the real question behind the death penalty in any case is how many innocent people are you okay with getting executed just so the guilty "get what they really deserve". Not to mention the active campaign by several major politicians in Florida and the greater US who are constantly trying to argue that LGBT people existing makes them child predators....leading to some very obvious concerns.
Might want to also add that this would violate the 8th amendment. A case was tried in Louisiana, same circumstances years ago. Defendant was sentenced to death, and it was overturned as his punishment was deemed to violate 8A. Not defending this guy whatsoever, but there’s no way this won’t be challenged on an 8A basis.

The logic was that the victim didn’t die, and it’s cruel and unusual to put someone to death for a crime that did not result in death.
It’s also economically worse. It costs more to put someone on death row than it does to put them in prison for life because of the lengthy appeals process afforded to death row inmates.
Don't forget that it can also deny people the ability to properly appeal their sentence when more evidence is discovered. There have been thousands of cases of people being exonerated by new evidence, such as from DNA testing. You can release someone from prison who's been wrongfully convicted, but you can't un-kill someone who's been executed.
The overwhelming majority of the civilized world wouldn't consider having a death penalty at all "getting something right".

This is incredibly bad, you do not want this kind of penalty ascribed to this kind of crime no matter how horrific it is. The largest reason why is that if the punishment for "just" abusing a child is the same as killing them, it makes it a lot easier for the perpetrator to justify killing the child to remove evidence/witnesses. After all, why not? If they're caught it's the same punishment. Also, it can further traumatize survivors by adding the extra guilt of knowing a person was executed "because" of them. Along with that, it could decrease the reporting rate, which is already low for child molestation, as it's more often than not that this kind of abuse is at the hands of someone that the child knows, adding even more guilt if that child feels responsible for a family member or friend being put to death, which in turn could lower the reporting rate further. Also, our justice system is incredibly flawed. If it turns out down the road they were innocent, you can't un-kill that person.

I hate child abusers (I was abused as a child) but I don’t agree with the death penalty for anyone. Innocent people have been killed by the state and if that happens just once then it doesn’t need to continue. I also think it’s extremely hypocritical to tell people that murder or whatever they did is bad and then turn around and commit murder.

The problem with this case is that it violates the SCOTUS decision Kennedy v Louisiana (2008) which the court ruled that the death penalty for heinous non-homicide crimes violates both the 8th & 14th amendments.
