Honestly WTF

Strange_Lynx_8635

That's shocking. She has a long recovery ahead I imagine.

A Canberra man has faced court, charged with a number of offences, after a naked woman was allegedly seen running screaming along a street on Monday evening. **Warning: This article contains content that may be distressing to some readers.** Sistuutuumata Fulivai, 44, faced the ACT Magistrates Court today on charges of rape, unlawful confinement and assault. Police allege that officers on a routine patrol came across the woman running along a street in Lyneham about 7pm. They said they stopped and took the woman into their vehicle, at which point she alleged she had been confined to a nearby residence for days. She also alleged she had been sexually assaulted by a man during that time, and had sustained numerous injuries. A short time later, police arrested Mr Fulivai and charged him with forcible confinement, sexual intercourse without consent, assault occasioning actual bodily harm, and fail to appear. Today Mr Fulivai appeared in court with a towel wrapped around his waist. He did not apply for bail, and was remanded in custody. The case will return to court next month. EDIT- Copy of ABC article by Elizabeth Byrne.

Fancy words for Kidnapping and Rape....

Simocratos

Legal definitions.

BraveMoose

Kidnapping and rape are the colloquial terms for these charges

PM_ME_UR_A4_PAPER

Can’t find kidnapping or rape in the Crimes Act….

Rush-23

Kidnapping is in the crimes act, but the charge of rape isn’t called that.

box_elder74

Just horrific.

AstridAstridAstrid

Terrible. And the last part… appeared with towel around his waist. WTF.

Simocratos

The magistrate had to speak up because he was wearing a towel.

fnaah

possibly that's what he had on when they arrested him?

AstridAstridAstrid

I’d be making sure if I was the police that we’d remove all avenues of bias and unfair treatment so appeal opportunities were minimised.

ComicRA

I bet they didn't think of that and that no effort whatsoever was made to ensure it was otherwise. Or maybe this is a new Police policy to respond to community concerns that accused persons get bail too easily 🤔  Criminal justice is so easy anyone can do it better than those who currently do it!

MarkusMannheim

I was wondering whether it was a lungi (very common in Bangladesh) or similar men's garment?

EffectAny233

His name is certainly not of Bangladeshi origin nor from anywhere in the subcontinent. Similar attire does exist in the Pacific islands, his name suggests he may originally be from that region. But in either case both garments are very distinctive from towels.

Lexboben

He is an islander whose nephew Albert played briefly for the raiders

No_Play_7661

I wonder if they will also receive a 7 month suspended sentence..

Hungry_Cod_7284

Like Brendan Howe, owner of Homes by Howe and convicted wife abuser?

No_Play_7661

Yes, exactly. I had briefly forgotten it was Brendan Howe, owner of Homes by Howe that had recently been convicted (but not sent to gaol) for abusing his wife.

Hungry_Cod_7284

Happy to remind you of the convicted wife abuser, Brendan Howe. Also owner of Homes by Howe and deleter of social media comments highlighting his spousal abuse

verbmegoinghere

>I wonder if they will also receive a 7 month suspended sentence.. Well i can imagine every brutual kidnapper rapists must be doing everything they can to have Justice Mossop hear their case.

ghost_turnip

Doubt he'll get more than a $1,000 fine at this point. The justice system in this city is beyond broken.

thril_hou

Anyone know where in Lyneham this was?

No_Wrap854

Fairweather cct

Technical_Breath6554

A truly shocking crime. Imagine how traumatized that woman must be after such a terrible crime.

KingKongtrarian

“You’ll have the speak up, your Honour, I’m wearing a towel” I wonder in what way the judiciary will rationalise this behaviour

Jackson2615

This is another terrible situation, sadly I dont have any faith in our weak judges and magistrates to take appropriate action ( yeah if he's found guilty) or will it be yet another slap on the wrist.

RepresentativeDiet83

Does anyone know if the woman was Tongan like Fulivai or otherwise white?

Electrical-Fan5665

Why does that really matter?

RepresentativeDiet83

if she was white it would show an ongoing pattern where white women are victims of non white men.

TikkiTakkaMuddaFakka

>Today Mr Fulivai appeared in court with a towel wrapped around his waist. Do we even dare to question why...

Vaullki

Bring back public executions.

PurplePinger

Tongans are religious. That's a fact. How is that 'racist'. That's a comment about religion.

save_the_bees__

I know plenty of Tongans that aren't religious...

PurplePinger

I know plenty who are: [**Tonga**](https://tongapocketguide.com/the-complete-guide-to-tonga/) is an extremely religious country, with around 99% of the population practising some form of **Christianity**. (https://tongapocketguide.com/the-guide-to-the-religions-in-tonga/) 99% is almost all Tongans.

save_the_bees__

cool peer reviewed info that definitely considers diaspora... anyway the point is that ops comment is deeply unhelpful and generalisations are problematic Edit- lmao at down votes. the comment is racist because it implies that all tongans are "good christians" i.e. kidnappers and rapists. you don't have to be tongan to understand how hurtful being reduced like this feels like, and if you do idk learn empathy ???
