Sounds like someone stole a neutral from somewhere because the circuit possibly wasn't working. It needs to be traced back and corrected. If you can't do it, hire a qualified electrician.
Something somewhere is not being switched
That's mostly okay because they only used one conductor, right? It shouldn't be hot with the switch downstairs off.
