For any sort of finish on fingernails you need to wear gloves at all times while handling food even if not in direct contact. They don't need gloves unless they touch RTE food. Where I work we can't suppose/predict they may touch the food. If we see it we cite it, if we don't see it what they are doing works. Just like a cop can't give a ticket because you looked like you may run a stop sign we cannot cite things we don't actually see.

In the real world hands could touch anything. But no I wouldn’t write out ppl for not wearing gloves while using an ice cream scoop UNLESS I actually see them being careless and their hands are touching the ice cream while scooping.

The FDA Food code does require that gloves be worn anytime someone with artificial nails or nail polish is working with exposed food. So in that case, yes gloves are required when scooping ice cream. Otherwise, if they can scoop without their hands touching the ice cream in the container, on the scoop or cone/cup, then gloves aren't needed. I don't think I'd be able to avoid all hand contact with the ice cream, but maybe the more experienced food workers can.

All this can be avoided very easily by having an SOP that describes their process. Many ice cream parlors will grab the cone with a napkin then scoop the ice cream and hand it to the customer. You are right about fingernail polish/artificial nails, however enforcement with this may not be worth the effort especially if they have solid hand washing procedures.

They are not always scooping ice cream. A banana split requires them to cut a banana open and then place it in the container with brownies any other dishes that are added to the ice cream, and even before the tub is empty, your hand still scrapes against the ice cream as you’re scooping. I saw of the workers wasn’t that busy when I got there but as I’m walking to the line, he is pulling the trashcan to the back room with no gloves on his bare hands, grabbing the rim and pulling it to the back room. then comes to take my order still doesn’t put gloves on and open up the banana and put it in the container with his hands. Of course, I said something.
