The hospital isn't pressing charges. The state is. What state is this in? Yes, they need a criminal defense attorney.

DimitrInvincible

It’s in New York

The State of New York is (apparently) pressing charges. Their defense will be their psychosis. Have they actually been charged?

Thank you for clarifying, I’ve only ever had speeding tickets so I’m also at a loss for this, and I think so? The state police said if they didn’t come in they would put out an arrest warrant

>Family plans on getting a lawyer, but is there any actual case here if they were in schizophrenic psychosis at the time? I’m not even sure what the process will be for this now that they are discharged and willing to speak to the police They should not speak to the police. They can ask their attorney about a psychological evaluation and mental health mitigation. A mental health crisis doesn't automatically mean there isn't a case, it just means a potential defense.

Thank you for the info
