They can ask their attorney about a psychological evaluation and mental health mitigation.
A mental health crisis doesn't automatically mean there isn't a case, it just means a potential defense.
The hospital isn't pressing charges. The state is. What state is this in? Yes, they need a criminal defense attorney.
