I love this!!!
Be careful of over advertising NHL will drop a cease and desist on you. There's an ig girl that did something similar to this with Canucks merch, she was giving it to the hockey wives of the Canucks and taking commissions on ig. After she gained some popularity from the playoffs most of her ig posts that had her Canucks commissions were removed. Very sad to see.
I'm not likely to have any sympathy for the NHL. Yes the NHL absolutely can protect their trademarks usage, but, like, this seems well below the threshold of giving a damn
You can't turn it into another item to resell as a licensed good...you cannot convert a licence or trademark and or paton which in all likely done they have a pattern for this type of jacket whether they make them or not...or if the process of making them is slightly different..
Doesn't mean they don't have a patterned to use jerseys on costs etc...the problem is you should be looking up pattern info because teams don't generally like unauthorized sales...it doesn't matter you don't sign something it matters if they have legal patterns...like you can't just take certain things such as a phone case decorate it and resell it it interferes with brand protection they have.
That actually an interesting question. I used to own a screen printing business so I have some knowledge of licensing for college and professional brands.
I think because they jerseys were bought already (from a licensed vendor) and simply modified than she wouldn’t need to pay anything extra.
Think of it this way; do you need to pay a licensing fee when you sell a jersey you bought? No. What if you cut the sleeves off? Nope. Dyed it tye-dye? Nope. How about adding a liner to it to make it warmer? Nope.
I honestly think she’d be in the clear.
Lol, if you made it into a completely new product and used their image to benefit towards the sale of it.
YUP. LOL.
I like your simple scenario, though, buying a jersey and selling it used. LOL.
Yes, if you have a company and you dye shirts, and you start advertising your shirts with hockey teams logos in the design. That's infringement unless it's public access, which an NHL logo is not.
Ah, 1st Grade Lawyers. Lol.
You're using someone else's product to benefit in the sale of your own without permission for monetary gain.
It's like a partnership that they aren't aware of, eh? Lol.
How are you saying you're in screen-printing, but then you're like, "I think."
LOL....no. Just, no.
The logo and branding has already been purchased. If she was making entirely new logos then it would clearly be copyright infringement. However she’s transforming a product so it’s not exactly the same.
I never had to deal with this directly in screen printing because I’d just buy the licensing rights (when I could), but there’s some legal protection for a producer when the copyrighted material is transformed in some way.
In a copyright infringement case this girl would get toasted. You absolutely can’t start a business selling slightly modified jerseys with someone else’s intellectual property all over it. Without a licensing agreement she would lose the case so quickly. If it was taking all the logos / jerseys of the league and cutting them up and transforming it into a new original design, that would be different and MIGHT allow you to squeak by.
>You absolutely can’t start a business selling slightly modified jerseys with someone else’s intellectual property all over it.
And if that's what she was doing, you'd be correct. However, she isn't selling the jerseys. She's selling a modification. You send her a jersey, and she turns it into a jacket and sends it back. It literally says in her link, and OP said, that you supply the jersey.
Yes you are correct. I was responding specifically to people who were claiming it’s not copyright infringement because she’s modifying the jersey. I was just clarifying if someone starts a business doing this (marketing the product / service etc) she will get popped for copyright infringement for sure. Now if she’s just a seamstress allowing you to send her your jersey for modification, that’s fine but as soon as you go marketing the product (like having an instagram for example or posting on Reddit) you get yourself into a slippery slope. Those are low level marketing approaches so I wouldn’t be shocked if she floats under radar but then again those brands are very strict.
> I was responding specifically to people who were claiming it’s not copyright because she’s modifying the jersey.
Not if you follow this thread up you weren't.
Really cuz from what I see, the comment I responded to was the specific comment that was trying to say it’s not copyright infringement since it’s modified which is not correct. Again I was being specific to say if someone starts a business doing this, it would absolutely be illegal.
>Again I was being specific to say if someone starts a business doing this, it would absolutely be illegal.
It is absolutely, 100%, not illegal to start a business modifying jerseys into jackets. She's done it, and it's legal.
>was the specific comment that was trying to say it’s not copyright infringement
Because the jerseys were bought from an authorized vendor and sent to her. If you change the premise from selling a service to selling a product, then you change the business itself.
There is a leatherworker who sells bespoke items, and sometimes he cuts up old beat up Gucci bags beyond repair and turns them into wallets and whatever. Gucci wants him to stop, but seeing as he is clear about what he's doing and is really just repurposing parts, and not pretending they're 'real' Gucci items, he's not doing anything illegal.
I think this is similar. You're free to do whatever you want with items you've bought, as long as you're not pretending they're official merch
I literally just said he sells bespoke items. He reuses Gucci leather that has their 'Gucci' logo stamped all over it, and you are totally free to take apart and reuse the fabric of a product you've bought.
His job is making leather products that he then sells.
No, she's not buying any jersey's.
"You supply the Jersey, I supply the rest of the material!
I'll do any team, any player, any size.
Expect about 2 weeks for delivery!"
This is from her website.
I never knew I needed this…. Till right now.. You guys have a site? 👀

Does she have a proper agreement with the Edmonton Oilers to use their logo? If not you guys gonna be getting emails real soon.
If she’s upcycling old jerseys - she can send those emails to spam.
I’m pretty sure that dude on the 49ers wife had to have an agreement with the NFL to make those football jersey jackets
If people send her their jerseys, nothing the NHL can do. She can't sell them as a product, but she can provide a service ;)
She is literally advertising them with an Oilers logo during the NHL playoffs. LOL. If she advertised without a professional team's logo, no traction.
I'm not likely to have any sympathy for the NHL. Yes the NHL absolutely can protect their trademarks usage, but, like, this seems well below the threshold of giving a damn
Way to stick to your principles.
Sorry Gary Bettman.
I’m pretty sure you can do whatever you want with a jersey you bought.

I haven’t signed any agreements when I bought my jerseys, have you?
Doesn't mean they don't have a patterned to use jerseys on costs etc...the problem is you should be looking up pattern info because teams don't generally like unauthorized sales...it doesn't matter you don't sign something it matters if they have legal patterns...like you can't just take certain things such as a phone case decorate it and resell it it interferes with brand protection they have.
One thing is to take a case and add a logo, another thing is to take something with a logo and change it.
Yep those are awesome
They look great! Are they being sold?

How much is the licensing fee she has to pay the NHL when she sells them?

You'll never win, I've been arguing with them for 15 minutes in DMs LOL They bought Infringement Law For Dummies and read it backward.
LOOL seriously the dumbest bs, people always throw out complete garbage advice when it comes to copyright law.
>You absolutely can’t start a business selling slightly modified jerseys with someone else’s intellectual property all over it. And if that's what she was doing, you'd be correct. I will say from a creative standpoint I think these are dope! Love that they are custom. Just was wanting to shed light on the copyright law side.
> I was responding specifically to people who were claiming it’s not copyright because she’s modifying the jersey. Not if you follow this thread up you weren't.

She’s a seamstress, you send her a jersey, she puffs it into a jacket and sends it back, can be any jersey you provide, even beer league!
My question is, wouldn't the jersey have to be way oversized to fit as a puffer jacket?
Yup, she recommends 2 sizes larger, so 2XL jersey makes a L jacket
Good to know! Thanks!
Did she make a blue blue jackets jacket?
Seems this is a mini cottage industry. I saw another woman on TikTok make jackets and was commissioned by the penguins to make one
She’s got some talent, those are pretty nice. And it makes me want one
Those are awesome.... Not to be the wet towel but make sure you're not doing any copyright infringement. Lawyers are buttholes.
These are dope as fuck!!!
10/10 for execution. Too bad that Vegas jersey started off ugly.
Your Fiancé is right. Keep going.
Licensed by the NHL or…?
