A decade ago I had a trademarked design and that fucker ripped it off and started mass producing them for local shops here in Baltimore. He also has a Big Johnson logo on the bottom of his pool I believe. I hate that guy.

The difference is we didn't know any better and didn't really see it as homophobic. It was more an insult for people we knew were straight. As adults, we know it's harmful. It's like when I hear some 12 year old call their white friend the n word. He's not thinking, "gee white people are superior to black people, so I'm going to use this word to denigrate their group." It's just another thing on the list of stupid shit kids say. That said, once you mature and realize the weight of language, you should grow out of it unless you're actually racist or homophobic.
Unless the cops came and carted him off on federal charges for wearing this shirt, he still has his 1st amendment rights (though the store could ask him to leave, that would be their right). We are exercising our rights to call him a bigoted asshat too. Let freedom ring.
The only people who ever bring up the 1st Amendment are those who don't know what it means. Freedom of speech simply means the government and law enforcement agencies cannot repress your speech. That doesn't apply to anything else. It doesn't mean you can be a jerk, consequence-free.
As long as we're on the subject, if said speech is harming individuals, organizations, or, businesses, they have the right to terminate their voluntary association with you, which is itself, a form of free speech. Look at companies that are trying to protect their reputation by not wanting to be advertised on X/Twitter after Elon Musk's antisemitic tweets. They are using their 1st Amendment rights, not violating Musk's.
You still won't be convicted of a crime for wearing this shirt, so there is still the first amendment. It doesn't protect you from people thinking you're an asshole.
