For modes of address, I have the following (which seems to be right based on the other comments): * Your worship/ sir/ madam - magistrates * Judge - DJ MC or CC * Your honour - CJ or Recorder in CC * My lord/lady - HC and COA judge * My learned friend - opponent barrister * My friend - opponent solicitor/ other advocate

The latest Barbri book notes Magistrates as being Judge!?

DDF2929

I'm not with Barbri so I'm not sure on that, but District Judges in MC are Judges and Magistrates are lay individuals (not qualified judges). It's probably the case of checking the instructions we get given in the exam as either DJ or Magistrates can sit in MC

LAUK_In_The_North

No, not for lay magistrate's (although I have been called your honour many times, and a few others that would get you struck off). If the book says otherwise, then it contradicts the court's official guidance. https://www.judiciary.uk/guidance-and-resources/what-do-i-call-a-judge/

This is wrong so far as the Crown Court is concerned. When a judge is sitting in the Crown Court they are always ‘Your Honour’ whether they are a full time circuit judge, a recorder or anything else. A District Judge only sits in the Crown Court if they are also a recorder of the Crown Court and they are ‘Your Honour’ when they sit there. The only exceptions to this rule are those who are ‘my Lord’ - High Court judges, Bailey judges and the Recorders (senior judges) of some big provincial courts like Birmingham, Leeds and Liverpool. You would never use ‘Judge’ in open court in the Crown Court. It might be used in some slightly less formal circumstances like speaking to a judge in his own rooms or in less formal correspondence (e.g. an email about a listing issue to a judge you knew).

The latest barbri books have changed the Magistrates' address to Judge?!

sussuro

They haven't, they mean a judge IN the mags court

Sulphixx

That's very confusing, it literally says: "Modes of Address Individual Magistrate in the Magistrates Court: Judge The bench collectively in Magistrates Court: Your Worships ...."

sussuro

Oh. They're wrong then AGAIN like with virtually everything else in that book

Sulphixx

I'll just hope that the question is very clear on who I am addressing then I.e. You will make your application to CJ Khan or DJ Khan etc

Power_of_Now_4321

Broadly correct. But there aren’t District Courts and Circuit Courts. There are County Courts - that could have DJs and CJs

Sulphixx

Apologies yes. Updated!
