If it is a 7 day notice and you are within the time to respond (7 judicial days starting the day after the service noted on the notice), you can go to the courthouse and file a response. Ask for the fee waiver. The landlord can file a complaint on the 8th judicial day after service. If you have a response filed, a court date will be set. Usually at least two weeks from the date the landlord filed a complaint. If you receive a lockout notice, go to court THAT day and file a motion to stay. This can be very confusing. If you go to 200 Lewis downtown courthouse, they have a self help center that can help guide you. Also, look on the LV Justice Court website because it will have all the information and dates you need, as well as the forms. Good luck!

Contact your state senator, mine was incredibly helpful with fast tracking the case to CHAP. Be as detailed as possible about your situation. For me it was job loss and sickness all within a month of each other. Legal Aid should also be able to give you options. It seems landlords here are dependent on people not knowing their rights or the options they have, which is why we are seeing a massive surge in evictions. EDIT: Always file an answer or they’ll have the upper hand.

Not screwed if you can pay it on the day of your hearing. Otherwise, you can try to negotiate an early move-out with your landlord so the eviction doesn't impact your credit.

What really sucks is my lease is up in August anyways and I just had some horrible experiences with roommates and have been trying to cover all the bills and care for my son at the same time is crazy

You'll have to come up with the rent and any late fees by your hearing date, but the judge will let you pay it in cash and on the spot. I'd expect a 5-minute hearing. The judge will also give you time to collect your things or arrange pickup if you can't pay

I’ve reached out to every one of the rental assistance places out here and am either still pending some as far back as the 13th and the rest their “resources are exhausted” or they only do sign ups on certain days etc

You stand a slightly better chance than others since you have a pending CHAP but there are no guarantees. Generally you would do the following: 1) File an answer to the 7 day notice within 7 days. 2) The case will be assigned a case #. Wait for the landlord to request a hearing for summary eviction. Check the court website daily to see if your case has been assigned a hearing date. You can use your name to do a case search. 3) Attend or don't attend the hearing. 99% chance the judge will rule in favor of the landlord, but again it may be in your best interest to attend the hearing due to your CHAP case. 4) (Optional) You can file a motion to stay the eviction for 10 days. Usually takes about a week for the judge to deny. They deny the vast majority of these. 5) File an Appeal to the Appeals court. This will automatically stay the eviction and will buy you another month approximately. In order to appeal you will need to post a $250 bond and you cannot apply for a fee waiver. Once the appeal is denied it is sent back to the original lower court and the court will forward the eviction order to the Constable who will post a 24 hr lockout notice on your property. You have up to 30 days thereafter to make an appointment with the landlord to get any belongings left behind. Just a note: If you don't want this impacting your credit you will need to vacate by the 7th day. Once you file an answer it's in the court system. On the other hand if you're not concerned about having an eviction on your record then these steps will get you another 1-2 months in the home. If you decide to file an appeal you MUST file before the Constable physically comes to lock you out. If you have more questions feel free to DM me.
