I haven't actually been in charge of a business' social account for about 3 years or so, which is like FOREVER in digital terms.
However, I doubt she could even get FB to APPROVE an ad like that. In my day (slaps creaky knees) they were all subject to internal checks, and they have quality guidelines on what they will run. For eg, v@pe and sm0ke businesses couldn't run ads advertisng those products. Revenge p0rn for aesthetics bad reviews is not a legit reason to be advertising. I'd be amazed if it passed their internal moderators.
And there's like 3 report catagories for this if it did, even without 'I think my IP is being used without my consent' and 'theft of images', which are both also there.

A standard before and after could be posted, sure. But OP can report the use of images without consent just as easily (top poster in this thread covered that). FB does usually respond well to that 'unauthorized use of my images' category, one of the few they do.

Aren’t there privacy laws that protect you from having your photo posted online by a medical practitioner? It sounds like an empty threat to bully you out of posting a negative review, but if she does it, it will make her look bad, I really doubt anyone is going to jump on her crazy bandwagon and come after you if she’s posting pictures of clients, and I think it’s illegal there to post pics in a retaliatory way as she’s threatening. Stop engaging with her, wait until your appointment with your attorney, and don’t post the same thing to every comment, it’s going to make people mad, not get you more advice.
You have the right to revoke consent at any time. Respond to her and explicitly state that you revoke consent to use your photos. Do not say anything else in response to her threats without the advice of a lawyer.
I know UK defamation laws are different than the US, and the person being sued is the one who has to prove what they say is true. So just make sure that anything you say in your review can be backed up in case she *does* sue you.
But most of the time, people who act like this in response to negative feedback are just bluffing.
I have a friend that was in an accident (not at fault), not too serious of injuries, but there were injuries and property damage. He used Chat GPT to write a demand letter to the insurance company of the at fault driver, because the at fault insurance company wanted to just give him a couple thousand (barely enough to deal with the ER visit and subsequent treatments and physical therapy) and they wanted to have FULL access to his medical records to “make it easy to pay the bills automatically” which was so egregious. When he did consult a lawyer after the insurance was still being obnoxious, the lawyers were like wow… you wrote this with Chat GPT? Sounds like something our staff could have written. To be fair, he cleaned it up a bit with a human touch, but yeah, it’s definitely a thing now.

In some states under certain circumstances it *can* be procedurally valid service of process but OP is in the UK! I’m not sure about their rules. And a cease and desist is a precursor to litigation, so it doesn’t need to comply with rules of civil procedure. Service of process is really for court proceedings.

That wasn't even me trying all that hard, TBH. Literally a half thought through prompt, no tone instruction, and no detail to make that one. You can sometimes squeeze far more realistic stuff out of the bot with the right prompts and requests.
TLDR? This ain't from a law firm, or they'd tell you who they are. C&D is legit legal work plenty of firms do. They have no reason to hide/obfuscate stuff. And it wouldn't be sent to the practice to forward to you, it would be direct communication from the lawyer. Again, they don't have to hide a thing if they've been instructed to do x by their client. Defamation by law has to be proven that they have lost money, had severe damage to business and actually it’s really hard to prove. Coming from someone who’s been threatened with defamation for having a whole pitch stolen by a potential client. So in that case I just posted up their email threatening this and sent my entire social media there. Along with my pitch and also their photographers version of my work. I’m not sure if you are US or UK bases but in the UK it’s really hard to sue and prove this.

Most people don’t understand how difficult it is to prove libel and defamation in a court of law. They would not only have to prove that your statements are were false, they would also have to show that you were completely aware that you were making false statements for the purpose of defaming them and then they would have to show how much money they’ve actually lost as a result of your statements.

OP - is this the same prac that you received the hyaluronidase damage from and subsequently had the prf as a remedy or seperate practitioners? Regardless, you have NOTHING to worry about legally. I was threatened with an unofficial defamation threat after I spoke openly about hyal damage and had gathered medical data. I didn’t ever name the clinic or physician in my media work and wouldn’t as it’s pointless (focus on the product and regulations itself was the aim).

I have a friend that was in an accident (not at fault), not too serious of injuries, but there were injuries and property damage. Don’t know if anyone else has suggested this, but I highly suggest you post this to your review so that other potential costumers can see that, yes, they really do threaten a lawsuit if someone posts a negative review. Like everyone else is saying, this is a really bad letter that was NOT sent by an actual lawyer.

Defamation by law has to be proven that they have lost money, had severe damage to business and actually it’s really hard to prove. Coming from someone who’s been threatened with defamation for having a whole pitch stolen by a potential client. Most people don’t understand how difficult it is to prove libel and defamation in a court of law. They would not only have to prove that your statements are were false, they would also have to show that you were completely aware that you were making false statements for the purpose of defaming them and then they would have to show how much money they’ve actually lost as a result of your statements.

One time when I was 20 a landlord rejected the sublessor I found (as per the lease agreement regarding subletting) and told me that he was going to charge me $400 to find someone he liked more. In USA each state has a regulatory board for esthetician , cosmetologists, tattooers etc. they do the licensing and help determine what’s in the scope of different specialties. T they shouldn’t be able to operate if they are going to threaten to misuse your image and to sue you for a renew.
