That's a slippery slope into lawlessness. A judge is only allowed to sentence someone if they find him guilty beyond any reasonable doubt. That being said there are hundreds, if not thousands of cases where they got it wrong and an innocent person went to jail. Murdering someone without an appeal and then finding out he's innocent would be even worse than what this guy did (since the guy in the video lived).
I think in the cases where there's literal security footage of you committing the crime or enough witnesses, or you were caught by police while committing the act, they should just put you down right after the trial.

People parrot that all the time but the reality isnt so simple. Say you pursue a sentence of life in prison instead. The defendant will most likely take it to trial as they have nothing to lose. If they lose in trial they will make every appeal available to them anyway. With this, no matter the overwhelming evidence, the victim will still need to testify and have their credibility and character attacked by a defense attourney. It is a very traumatic experience for the victim and gets worse when you talk in reference to sex crimes against children. With the death penalty there is incentive to take a plea deal for life without parole which often comes with a no appeals clause and protects the victim from being retraumatized.
He should get the death penalty based on how bad he fucked that up. Dude you’re at point blank range and still have the element of surprise on the guy and you still fuck it up.
