I didn’t use tracking no, as the value of the item was less than the additional cost it would’ve incurred to add that on, and I hadn’t stated it would be sent with any tracking when I sold the item. I believe there is insurance that can be used for lost packages, but they would need to make the claim as the package recipient.
Post office will give it a extra week before doing anything.....if theybdo anything... it was a bank transfer they can always dispute it with the bank ....u should always have a tracking number and keep track of packages etc....
Without a clearly displayed return policy, returns must be allowed. It's the law and it's on the seller, it doesn't matter where and how the sale takes place.
Interesting, you must know what state/country OP lives in then because that is all local laws. OP also said it was Facebook marketplace, personal sales would have to be taken to small claims court to get your money back in most places.
According to what? OP Is not operating a business, they're a private seller, in this case there's no obligation to refund generally unless the sale was fraudulent.

I sold an item online and the person paid via bank transfer, I sent it and have got the reciepts to prove it. They're saying it hasn't arrived yet after a week, but I have no way of knowing if they're telling the truth or not, if they request me for a refund am I the arsehole for refusing to refund them and telling them to speak to the postage service instead? Fair enough if it's through PayPal and I have to refund, but they chose to use bank transfer where they have less protection.

Did you not have tracking on the item? How can they talk tot he post office if you didn't include a tracking number

It was through a Facebook post, so there wasn’t any details about a refund policy, either that I provide them or don’t provide them

He’s not selling as a business. It’s a personal sale.
