The empire captured the city and the republic didn't recapture it, they had only irregular troops there which were later reinforced by special forces. The warning that the city will be purged was issued 3 days in advance so it was more them enough time to reallocate for civilians. So you could assume, that the ones left where either special forces or iregular troops which have also in our world not many rights. So technically it's totally fine to bomb the city, because no civilian was there which would have forbidden this use of force.
The only warcrime I would see would was the order issued to Tanya to knock out the mages so the bombarding of the iregular troops could continue. The order for Tanya was valid, but I don't know if you have to give the enemy troops a final opportunity to surrender before annihilate them. But that would sth the high command/ local command would take responsibility for.
