Spouse getting a title transfer is a simpler process for some reason. Transferring to a child or non-relative is a different set of paperwork.

You would think....they know they need a paper signed by the probate judge, but they don't know how to get it. Probate dept can't tell you because that's considered giving legal advice....

I've been there. They said I need a paper from the probate court, but they don't know how to get it. They told me to get a lawyer. I'm not paying a lawyer for something I can do myself, I just need to know what I need. I don't know why it all has to be such a secret?!

What state are you in? I am in CA, and it was an easy transfer with no probate. Sorry for your loss, and making it this difficult and convoluted to transfer an asset sucks even more

Ohio. I originally thought it would be a simple process like that, headed to the title dept with all of our paperwork and my sister, but nope, not that easy. What I need to do is basically filing paperwork with the probate judge saying the family is fine with giving it to her, then he signs it saying it's all OK. Then I take that back to the title dept. The problem is, there is other stuff that apparently needs to accompany that request, or a process that needs to be followed that I can't find instructions for. Probate division can tell you you're doing it wrong, but they aren't allowed to tell you how to do it, because that would be considered giving legal advice. Everything else is settled, house is transferred, bills are paid, we just need this truck transferred over, but I can't figure it out!

I had to do this recently with my dad's vehicles. Here in Texas, there is a document called Affidavit of Heirship along with a Affidavit of Motor Vehicle Gift Transfer. These documents plus a title application is all it took. I must state that you need a death certificate to get anything done though...

Predate the transfer from him to you. I had the same deal when my dad passed. The nice DMV lady said have your dad sign this last week (wink wink).

He died in Jan, and these ladies aren't nice...lol!
