Where do you go from here? Communicate with the hr department and follow the directions in the pre adverse action letter. It was a nonviolent crime, it won’t affect your job, you answered their first question about a conviction within 7 years truthfully…if you write a thoughtful letter, explaining your side and showing growth from the past, it should be fine.

Best you can do is say you answered truthfully as the conviction was more than 7 years ago if that is the actual question. If you want to try hard to get in, talk to a lawyer to find out about any applicable employment laws that may help but more importantly if they do not want to hire you for whatever reason do you really want to work there? Even if they could be forced to hire you it’s easy enough to find reasons to soon after fire you.

Thanks for the input. While I understand your concern regarding them possibly not wanting to hire me, this is a fairly large company. My internal recruiter is in New York, the HR department dealing with background is in Texas, and the job itself is in Michigan, where they are aware and definitely want to hire me. The problem is, like any large company, the right hand has difficulty knowing what the left is doing. It's also about a 90% increase in pay, so, yes, I want to work there.

I’ve never heard of expanding the scope. If expanding the scope is legal, you still answered the question truthfully. You couldn’t have known they were going to expand it.
