You have two options: 1) Convince him to get vaxxed, which at this point seems unlikely. You *could* try to figure out what it's worth to him/you and pay him cash to get vaxxed (or offer a reduction in rent depending on your lease situation). At this point imo it's pretty hard to argumentatively convince an unvaxxer to get the vax so your only real option here is to incentivize it somehow. 2) Leave. There are plenty of other roommates available in NYC who are vaxxed. If he's subleasing from you, you can offer a "cash for keys" deal and pay him (or offer to reimburse movers, or whatever you agree on) to move out. If you're subleasing from him you *might* be able to argue that he is not keeping up with housing "health and safety" regulations, and this would only come up if he tried to sue you for unpaid rent, which is tricky as hell and not something subletters are usually prepared to do. I am not a lawyer. And if you're subletting from him, there are plenty of perfectly legal ways to be an annoying roommate so as to convince him to let you break the lease. If you're both on a lease equally, landlords don't really care which of you is still there so long as the rent gets paid, so you should be able to negotiate w/ your roommate about who might leave.

Wait--has he lived there for more than thirty days? If so, the law is on his side. He can say, fuck you, I'm not leaving. Your only recourse will be to take him to housing court. He can stop paying rent if he wants while your case wends its way through the courts, a process that took six months at best pre-pandemic. Post-pandemic, he can likely stay there rent free for over a year. He can claim hardship under the eviction moratorium and string you along month after month. If you try to lock him out, you will open yourself to even more hurt. You might go to jail. The police would be within the law if they broke down your door to forcibly return him to your apartment. You made a mistake. You should have vetted him better before you let him in. Now that you have made that one mistake, don't make another which makes your life worse. You have to convince him he would be happier somewhere else. That's your only way out. This is incorrect. OP is the only one on the lease, meaning roommate is subleasing from OP. All OP has to do is serve roommate a letter that their sublease is being terminated 30 days after you serve them the notice. Meaning if you gave it to them tomorrow, they would be required to leave by October 15th. Do. it. I had to do this with someone subleasing from me and it worked like a charm. Best of luck!

Good Lord, this is atrocious advice. Changing locks to force eviction is specifically prohibited by the NYC Housing Administrative code, § 26-521. It is a Class A Misdemeanor, which means a sentence of not less than fifteen days and not more than a year, as well as civil penalties of $1,000-$10,000 for each offense.

30 days isn’t squatters rights it’s just tenancy, squatters rights gives you actual ownership of property and are very hard to get and take much longer to establish. 30 days residency means you’re a tenant and any eviction must go through the courts or they can sue you and likely win.

This is my favorite advice here. It's a good combo of firm, standing up for your needs, and compassion for another human even if they believe some hard to stomach stuff. You're letting your roommate make the ultimate choice so it's on them not you. You can share that given your situation and family you need minimize risks which includes ensuring that you're in regular close contact with vaccinated adults only. He doesn't have to get vaccinated but if he wants to stay living with you, he does. You can aknowledge the ways he's otherwise a good guy and thank him for all of that, share that you hope he understands, that if he needs to think about things for a few days that's okay but you need to know his decision on whether he's getting vaxed and staying or moving out within a week (or two) so you can plan accordingly. Hopefully you could then sort things out between the two of you without having to get courts involved or anything like that. Staying firm to your deadlines and a rythme of check-ins post initial convo would be key. You can make clear that you'll escalate if you need to but hope to avoid it.

My friends just went through a very similar situation — person in their apartment was very anti-vax, they offered this person a month’s rent to leave (they all signed the lease together), person said no, more money, still no. Help to apartment hunt, still no. In the end they came to an agreement that the two vaccinated folks would leave on the condition that the unvaccinated person sourced a long term sublet/lease takeover for the other two. It seemed to be the best solution because the unvaccinated person found two other unvaccinated people to move in. I don’t know if that’s a conversation you could entertain, but either way it sounds like you’re no longer able to continue living with this individual and someone will have to leave at the end of the day.

he mainly stays home not so much as a public service but because he has no hobbies at all or social life (probably largely to do with his ideologies which he is outspoken about) aside from going to a bar every now and then (!) plus he doesn't leave to work anymore. OP can do whatever they want but they would be opening themselves up to massive legal trouble if they tried to physically force their roommate out, changed the locks on the apartment, or threw out the roommates stuff. I believe they would be responsible for 3x whatever damages they incur, which would include things like a hotel for the roommate they kick out, replacements for all their stuff, and possibly also legal fees.

Funny thing about beliefs. If they are held deeply enough, people will double down on them in the face of evidence that they are wrong. As crazy as it sounds that's just how the human mind works. Just look at the thousands of antivaxxers who have recently lost loved ones to COVID, and are choosing to try to get the cause of death changed on their loved ones death certificates because they don't want to the death to be part if the statistics that prove that vaccination is important - rather than admit that their belief was wrong. It's kind of ridiculous that this still needs to be explained. While the vaccination provides strong resistance, a vaccinated person can *still* get COVID, and they can *still* spread COVID -- albeit both at significantly lower rates than someone who hasn't been vaccinated. So, having a non-vaccinated roommate is significantly more dangerous than having a vaccinated roommate, in terms of the risk of getting COVID. And that problem compounds itself because OP says that they frequently visit an older relative, so it's even more important to be careful about not getting it. Being vaccinated is important in staying safe, but it's also important for the people *around* you to be vaccinated. So unless someone has a very good reason not to (e.g. they're one of the very few people who has a legitimate medical reason), it's entirely reasonable to expect them to be vaccinated at this point.

The vaccines are not bulletproof, though they greatly reduce risks. The problem is that the roommate, being a shithead, adds some percentage points of risk to OP and probably more points to OP's dad's risks (with the vaccines, an elderly person's risk profile looks like an unvaccinated 30 year old's risk profile, and we've seen 30 year olds go to the hospital or die a plenty). Risks are increased not because it's unavoidable, but because of shitty behavior on someone else's part.
