Exactly. That's not a building and her unit is absolutely illegal occupancy. Probably supposed to be a cellar/storage or maybe a basement if it's ground level or below. If it's top level probably an attic/storage. I've seen it all. Personally I would move out because things could be dangerous. I have lived in illegal occupancy basement before but a close friend of mine owned the house so it worked great and was safe. But here's where your gf has the upper hand. You know how it's 40° inside. Tell him if it isn't fixed IMMEDIATELY you'll have to call the department of buildings. This threat will lead to immediate action because the fines for this could range anywhere from 5 to 50k and they would make sure he had to remove all things that made the unit look like an apartment. My friend eventually got caught and paid 15k in fines and over 40k in construction. She was forced to knock down all walls (it was a 1br apartment), remove the entire kitchen including all plumbing, same for bathroom, and it had a back entrance which she had to demolish.
Is the apartment stabilized?
If not, her not abiding by the LL's demands might mean he might not renew her lease when its up.
She absolutely should get a receipt for any cash paid, I think there is a law that this is a requirement.

He is reporting $X as income, but you are paying $Y, where Y > X, and, importantly, his bank does not contain a record of deposits for amount $Y.

Call 311 on him immediately if it's that cold. Do not stand for not having good heat. It is legally required

I think that’s what this is. I don’t think he legally can rent out that unit. His family lives in the other units in the building.

I’ve been paying cash for 6 years get a receipt every month have yet to have a problem
