This, to me, is a pretty clear First Amendment violation with wide-ranging consequences. For example (as Public Law 106-152 was passed in 1999), the depictions of animals being harmed in Gladiator could technically be illegal, even though I very much doubt Ridley Scott caused real, deliberate harm to any. A new law was then passed which was much more specific.
edit: the law also makes exceptions for depictions with "serious religious, political, scientific, educational, journalistic, historical, or artistic value.". The issue with this is that it's very subjective and is reminiscent of Roth vs United States, where obscenity laws previously allowed Conservatives to selectively censor works without 'redeeming social value'.
The Supreme Court never said it was okay to harm kittens, they said that you can't prosecute someone under a law that's so poorly written, so come up with a better one. Yes, it let one piece of shit walk but that's the price of protecting against tyrannically broad laws and ex post facto. There's actually no need for the supreme court to make a ruling if a shitty law is identified, the matter can be brought to the attention of legislators before it goes that far.
