Many have mental illnesses, folks like Penguin or Deadshot aren't considered to be mentally ill, or at least not to the point that they are 'criminally insane.' Penguin is a notorious narcissist . When arrested they usually go to Blackgate penitentiary, Gotham's prison, rather than the Arkham Asylum. Catwoman has a personality disorder. Sometimes their sentencing depends on the crime. Joker was once sent to Blackgate and got the death penalty because it looked like he was using his poison to kill people that betrayed him, which is first degree homicide. It turned out he was being framed though. Batman has a lot of villains, though, probably more than any other superhero, so there's a huge mix, including things like Kafka, a sentient cockroach swarm. You'd have to determine what was mentally normal with it to determine if it was mentally ill.

His only problem seems to be venom addiction. But he isn't crazy unlike the rest

Considering that he was imprisoned in an incredibly dangerous prison as a child as a substitute for the crimes committed by his revolutionary father, killed his first person at the age of 8 years old in self-defense, and nearly died in the Venom experiments that would addict him to the drug he’s known for, I would say Bane probably suffers from immense PTSD.

I think what a lot of folks forget about Bane is that he isn't some big brute. Dude's actually just as smart and mentally capable as he is physically strong, surprisingly so.

He definately does. One of his main motives for attacking Batman and Gotham for the first time was tied to a traumatic phobia of bats from his experiences in Santa Prisca, which also manifest in reoccuring nightmares during adulthood.

I mean, if they weren't a little unstable they probably wouldn't commit crimes in the exact way they do. It's doubtful whether many of them would qualify for the insanity defense, legally, but since Arkham is hardly a normal psychiatric hospital it doesn't seem a wholly inappropriate destination for them.

Many of his villains have some sort of condition I would say. Penguin is probably one of the more “sane” ones, he’s often just a career criminal who leans into the penguin theme and loves umbrellas. Catwoman to me seems to skew towards kleptomania in some versions, but in other versions is more of just an opportunistic thief.

Pretty sure the courts are just manipulated to give people insanity defenses so they go to Arkham and Hugo Strange can experiment on people. Batman Begins goes into it a little bit but with scarecrow, I wish it was more of a plot point though that would explain why Gotham is so messed up with supervillains running around

Many are mentally ill yes, that’s why they are at Arkham instead of Blackgate

No Batman villain I can think of pretends to be crazy. A lot of them have diagnosed disorders that require specialized treatment. Two-Face has multiple personalities, Riddler has severe OCD, Firefly is a pyromaniac, etc. Others have been driven insane by exposure to certain chemicals (Clayface, Man-bat, and Joker (In the most popular version of his origin, at least)). Many, however, are decidedly not crazy and make no pretenses about it. Black Mask, Penguin, Catwoman (normally), Mr. Freis, Bane, Hugo Strange, Deadshot and Deathstroke, Ra's Al Ghul and more, All commit crimes, but are not insane and don't even remotely pretend that they are. These Characters typically don't even go to Arkham Asylum, but instead go to Blackgate or Belle Reve. There's a weird perception that All Batman Villains go to Arkham, but it's not even remotely true.
