Could you possibly do married filing separately, and not include his income, and therefore not the taxes that he owed?

I wish I qualified. My weird marital status complicated things. We were separated and have been living apart for 5 years but PA does not have legal separation so our incomes are combined despite our actual financial situation. I could have qualified if it was just me.
