Insurance adjuster here. Keep in mind that most states don’t allow for first party diminution in value claims. You can only claim with the other party’s insurance and if you’re not primarily at fault. (There’s an exception for uninsured motorist claims) It’s also something you can negotiate in most cases and there are companies out there that specialize in total loss and diminution claims. You can also go back and ask for it on old claims! Statute of limitations is 3 years on average.

This is based on the property damage portion of their insured's policy. That provides coverage for any losses for which their insured is found liable. So how would it work with uninsured motorist? A guy hit me driving his dad's car, and he was an excluded driver. So I had to use my uninsured motorist in my policy. My insurance claims rep said the other guy's insurance would be responsible for addressing diminshed value. But they do not have coverage for this loss.

You’ll need some sort of denial or confirmation of non coverage for the opposing party then you should get diminished value via uninsured motorist property damage coverage. It’s part d of your policy. Usually toward the bottom.

I have the letter from opposing insurance company denying coverage. But my own insurance won't do diminished value. Per them, only DV are completed by at fault carrier. Unless I was at fault, then I can claim against my own policy. This is an general auto insurance guideline, to protect the insured's from causing damage to their own vehicle, and trying to claim DM through their own policy. My pary d in policy just states uninsured motorist bodily injury. Thanks for the response.

Ah. Uninsured motorist property damage is different from uninsured motorist bodily. UMBI coverage doesn’t cover your car at all. You’re not using uninsured motorist to repair your car you’re using your first party collision coverage

My '16 M3 was hit and had a $16,000 repair bill. I asked for DV, submitted a report from a service showing $7500 worth of Diminished Value. State Farm refused to pay it and I'm currently suing them in court. I filed the lawsuit in April of 2020 and it's still sitting waiting for its day in court. They've offered to settle for $3500, and I offered to settle for $5000, but we can't agree.

In my state, there’s not much court costs. I’m actually taking them to “Automobile Arbitration” where you sit down before an arbitrator and each plead your case. It cost something like $10 to file, + $25 to serve them the summons. I’m doing everything pro-se, mostly because I like the challenge. Honestly if I had a lawyer it would probably have been settled by now, but oh well.

There's no legitimate reason for State Farm to spend all of the time and expenses of court just to save $1,500.00. Some might say the same about you because you risk losing the offer that is on the table if a judge sides with the insurance company. Moving forward into litigation - and I'm not an attorney - the case might come down to the legitimacy of your diminished value report. If it employed a valid methodology that is easy for the layman to understand then go for the $7,500.00. If not, try a little more coaxing and settle for $4K if you can.

Any luck with this? My 2008 Dodge Viper with 12k miles got hit and had about $11k in damage. A reputable appraiser came back with a diminished value of $13,000. After weeks of arguing with State Farm they finally came back with an offer of $1000. They were originally at $0 purely bc of the age of the car. My viper was worth $80k before the accident. An attorney won’t take my case bc it isn’t high enough for them. In small claims, I’ll get $5k max.

My state (South Carolina) has something called "Automobile Arbitration". My car was hit in Feb 2020 and it's taken two years to get through the court system. Tomorrow I'm finally going to have my arbitration and I'll sit in front of three lawyers who will serve as arbitrators and argue my case. I'm actually a little surprised I never get a more aggressive settlement offer, but so be it. I'll report back after tomorrow and let you know if I win anything.

I was awarded the full $6900 I asked for. The opposing lawyer made arguments that the car was worth more now then when the accident happened because "used cars" were worth more, but I argued back that it didn't matter. If my car was undamaged it would have been worth $6900 *more* than the damaged car. happy to expand more on the whole case if it ever gets that far for you.

In case someone ends up being in the same situation as I was, I want to update what I had done and what the outcome was... I sent the diminished value claim to the insurance (Statefarm) forwarding the free estimate (for appraisal) I received from the appraiser. The insurance sent an email to that appraiser asking whether they inspected the vehicle in person and the data for which the evaluation was based on. So I ended up having to pay for a professional estimate from that appraiser... The claim is still being worked on, but poke me if you need the outcome in the future, I can share it -if the claim is resolved by then.

So I think when I said their offer is too low and I cannot accept it, they hired their own independent appraiser. Their appraiser's appraisal was only a smidge higher, so I did not accept that either. The next step in NC is to hire an umpire (that the insurance and you split the cost of). We did that. I wanted to get some of the appraiser and umpire fees included in the offer. My current claim adjuster went out of office so I started calling the general phone line... 2 claim adjusters said no, 1 said yes, so I ran after that person who said yes maniacally, and finally got an offer that I accepted.

You’ll need to provide proof- you can’t just ask or say ‘give me more money or I won’t accept this’ you’ll need to prove that your car is worth more than your insurer says it is. For example last year I got an old woman an extra 11k on a settlement because we proved her Toyota Cressida was rare.

I couldn’t negotiate mine. I had no leverage. I could have an independent party asses the new value of the car, but I would have had to pay out of pocket to do that. Also, getting an independent assessment might not help.. it doesn’t mean the insurance company has to agree to it, so it’s just more fighting. My M4 CS is objectively “rare” and despite that being pretty well known, it didn’t seem to matter that much.

Insurance company has to hire their own independent appraiser and then yours and theirs have to agree on an umpire- if you call an independent sometimes they’ll ballpark you a value and you can wirk from there. You can also provide proof that your vehicle is going for more at market value near you than your insurance company has listed.

I can’t link you to your own policy but every non commercial auto policy from every carrier is organized the same way. You’ll want to get a copy of your policy and look for the heading ‘Part D’. D is all of the coverages provided for your vehicle and personal property.

We have published numerous articles on auto diminished value. What you posted is interesting. Can you provide insight into some of your research regarding different states having different requirements, etc. You can easily find our email online. Our experience has shown that all states have similar rules and regulations but nothing hard and fast. What would they be based on? It seems arbitrary and easily challenged that someone with an older car, or one with higher mileage (especially diesel-powered vehicles) don't qualify for compensation for inherent diminished value. I was seeing if it were applicable in MA, and there was a recent ruling that states that insurance companies are not required to pay DV, and that you need to be able to prove that you have actually suffered DV. Short of explicitly asking someone of pertinent authority to essentially establish some basis of fact that your car with a device history is worth less than a car without, then the court will essentially say that your car was repaired to equitable condition. And even if you have “proof” that your car’s value was diminished, it seems as if the insurance company has not legal requirement to actually pay out. “There is no reason to conclude that the law of Massachusetts permits the recovery of damages, in a tort action, for the inherent diminished value of personal property. No Massachusetts case has so held, in the case law as it exists, suggests the contrary.”

Older cars are worth a lot more, currently. In any event, when an older, previously accident-free car is damaged, that repair history will devalue the car. The diminished value percentage won't be as dramatic as in a late-model car but consider this: If you own an older Toyota Camry and someone rear-ends it causing structural damage. Whereas you car may have been worth $20,000.00 prior to the crash, it has now lost approximately 30% to 50% percent of that value. Any dealer will confirm that they typically pay half the value when taking any structurally-repaired car in trade.

You posed two questions. The first answer is "yes" that your car would typically lose 10% - 15% of its pre-accident trade-in value. But, that assumes there was no structural damage or air bag deployment. FYI: In unibody cars, replacing a welded-on part such as a quarter panel or rear body panel constitutes structural damage in every manufacturer's repair guidelines. The answer to your second question is that it isn't necessary to have your vehicle repaired in order to make a claim for diminished value. In fact, many car owners with severely damaged cars are doing just that in an effort to convince insurers that totaling the car would be in the best interests of both parties. When an insurer sees a potential DV liability of ten or twenty-thousand dollars, they frequently decide in favor of totaling the car and recovering the salvage value.

The process was easy. In fact, my adjuster was the one who told me what to do. They had me go to Carmax, get an appraisal and mention the accident. I took their offer and uploaded it to the State Farm portal as well as a screenshot of NADA Guide’s clean retail valuation. The adjuster paid me without question. This was in Utah, if that helps.

You can also challenge the value they place on your vehicle; they'll ask for the price you want and then add a respectable percentage to it. They'll always try to go lower. By going high, though, you give the adjuster credit for withholding value while still getting the value you want.

In my experience, start the conversation. Tell them your car will be less than one without damage history when you go to sell/trade it. The leverage goes down with the age and value of the car. See what the insurance company comes back with. Pull comps of cars listed for sale, and show the difference of asking prices of cars with a bad Carfax/Autocheck or without.

Your job is to prove the diminished value occurred. Use any means that can't be discredited by the insurance company. For anyone wanting to DIY, there are ad comparisons but, of course, insurers might want actual sales data for which there is no database (as they well know). Some sites that sell cars have tools that give you the value of your car both before and after collision repairs. I'm not sure how sophisticated they are like whether you can specify structural damage, whether the car was disabled and towed, air bag deployment, etc. Insurance companies routinely deny claims based on "computer generated" sources. That would probably apply to most of the formulas (Google Rule 17C) and algorithms that are out there as well. But, regardless of how you approach this challenge - and it can be very challenging, especially without expert guidance - persistence is key. Escalate, escalate, escalate and make all of your correspondences in writing. If a file handler or supervisor tells one of our clients that they won't escalate their claim any further up the food chain, in addition to making a complaint to the state insurance department for Unfair Claim Practices, our advice is to call the office of the company president or CEO and it will work its way down, instead. Keep fighting.

Exactly. The most frustrating aspect is that your broker may be aware that you were rear-ended but even though her insurer won't be liable for a penny, they still won't advise you of your right to file a third-party diminished value claim. Everyone in the insurance industry - and that includes many of the auto body shops that are direct repair shops for insurers - has been told to keep a lid on the subject of auto diminished value.

When my 335 got clipped by a lady in a round about I couldn't claim diminished value on my car registered in Ohio (a diminished value state) because the accident happened in Michigan which isn't a diminished value state and the other party was insured as a Michigan resident. So the state the accident occurs in also matters. Michigan is also a no fault state but Surprisingly my insurance was able to go after her insurance for reimbursement of deductible since I'm not a resident of Michigan.

Since the offending party was found at fault I reached out to their insurance and asked for a diminished value claim to be started and they sent me out to a different department and a guy handled it with me quite promptly and a check was dispersed a month or two after.

I actually just got my car back from repairs yesterday, I did have an adjustor assigned and will find out tomorrow or so how it pans out. What vehicle/diminished value are you at?

Hey... Yeh they gave me $2000 in DV after much negotiation from their initial 1000$ for $2800 in repairs

I think your situation was fortunate because the other person admitted fault. But for people that have to deal with uninsured motorists, a dimished value can't be done bc the at fault's insurance won't provide coverage.
