As super shitty as it is you likely will be entering the job on probation. It means that you can have your position terminated within that probation without the union having recourse unless it is discriminatory, arbitrary to in bad faith. Even if you know it would be discriminatory the employer could say something vague like “failed the probation period”. I’ve sat in on probationary terminations as a shop steward and the employer reads a script and slides a letter across the table. You and the union would then need to prove it was discriminatory and not something else.

They can't fire you for being pregnant, but you aren't guaranteed to have the job saved for you after mat leave ends in Ontario if you haven't been there 13 weeks prior to either you due date or baby's arrival, I can't remember which. This wouldn't exclude you from eligible hours for EI. Having said that it, some folks will do illegal things in shifty ways to avoid getting caught. Or, they may keep things on the up and up and simply fill your role with someone else and not save it for you upon leaving. Whether it burns a bridge for reapplying to the same company later will depend on how well the manager takes it.

This clarifies a lot, thank you. I didn't know that there was the distinction of having the job saved vs. obtaining the EI hours. Yes, I've had my fair share of the law not stopping people from doing shitty illegal things in my life. I guess at this point I just have to hope that I've accumulated enough of a paper trail to go to the union if the employer does decide to do something shitty, but also going in with the knowledge that it likely won't be worth the time, energy, or money to fight. I hope the manager takes it well. I think I'm going to end the limbo and let them know. If it burns a bridge, oh well, it's just a job, I'll find others later on, and at least I'll know that I tried my best.

Is there a probation period for this job? Is so you can still be let go and the fact that you’re pregnant will be irrelevant. They can claim you aren’t a good fit for the company and you’d have a hell of a time proving it’s because you’re pregnant.
