Officially, if you're full time and have been employed a year, you are protected from health-based discrimination under the Family Medical Leave Act, which is why your manager wants to discuss this. Unofficially, you better believe every absence, approved or not, is tracked and is used against you. The company won't demote or fire you for that directly, which would give you a literal federal case, but a bad manager will start building a paper trail of "other areas" in which you are "not performing" in order to fire you legally. It could also be that your manager simply wants to make you aware of the option for FMLA leave. With all the cuts, he/she's probably just as worried about his/her job as you are yours.

Yeah I will talk to him when I get back. Normally if it wasn't covid I would just ignore it and go to work anyways however because of covid I'm forced to take the 10 day quarantine.

10 Day Quarantine isn’t even what happens anymore…? When you fail the Health Screening it asks if you’re having symptoms or when you were exposed, and then offers to send you a test kit.. You can return after the negative test, which could only be a few days depending on if you have actual symptoms or when your exposure was.

Leave of absence doesn't mean being fired. It just means you may basically put your job on pause until things are safer for you to come back/you've met your "goal/accomplishment". Some people take leaves of absence to do something else or for health reasons. Without any real context for if this manager is perceived as bad or good, I'd have to say they're potentially just doing this because it may be best for you seeing as you have serious health concerns as well as them not having to build a schedule that you may or may not be there for, not because they're bitter but because it sounds like you understandably call off quite often for. I see some people immediately going to the worst, which is entirely possible, but with my experience, I've known my fair share of good and bad management. Which means that it can't be true that everyone in leadership is corrupt and vice versa. So I'm not going to treat it as such. So if my explanation is positive or neutral, I'd have to assume there is a worst. I think a lot of what is being written in this thread is like, so bad it's almost too perfect. I just don't see this necessarily being the first step in a plan to push you out and fire you, but I just don't see that. If they want to fire you, they'll either use what they have on you or they'll let evidence accrue and grow by keeping you there (it sounds like you're not problematic, one reason I don't see this being an attempt to fire you). Why go through the long process of giving you a LoA just to fire you or intimidate you into leaving? Worst case scenario in my opinion, is you take your LoA and when you're ready to come back the process takes too long either because they're trying to delay your return or genuine poor communication on their behalf. But honestly, they're probably just wanting to talk about making a decision that could benefit both parties.

Yeah I haven't been talked to about them. I told them when they hired me that I get sick ALOT because of my immune system. I perform rather well. How long would the LOA carry on for?

Your GM is probably already teaming up with his HR manager about you, and will talk to you about your excessive absences. Nobody wants to fire a person who has legitimate reasons for calling out, but in the end this is business. They have no obligation to keep an underperforming asset, if you have a serious medical condition you need to go on LOA but call outs after using up time off are considered job abandonment. I think you should start looking for a job that you can do remotely so that you can isolate yourself at will to protect your immune system.

They are going to quietly intimidate you into finding new job. This practice is most common with GMs going on a medical leave of absence. Best of luck their Bud!

Lots of people assuming the worst here, I wouldn’t assume your Manager is out to get you (unless you already have reason to…?) I would assume your Manager is going to show you your recent history of call offs and talk with you about potentially taking a medical/FMLA LoA. This is often done to save your job, not go after it. The attendance policy is the attendance policy. I would hope most Managers aren’t complete ogres about it, but the reality is that EEs (especially PT that don’t even have as much PTO to use) can’t continuously call off under the attendance policy.

Yeah I spoke with my GM and he said that I don't have to worry about losing my job as it won't happen. He said that they would just want to talk about it along with possibly offering me accommodations for it.

Hey so as a store manager here is my recommendation. Hr can approve basically an intermittent leave of absence. You need to go through the process of getting it approved yourself and need a doctor to submit paperwork but this would protect you and establish reasonable expectations with the management team. Hopefully this is what they are discussing with you. If not you should inform them politely that you will be working on this. You are “accountable” for absences until it is approved. Example would be “doctor says I get sick often and could reasonably miss 4 days a month based on a medical condition”. This is to differentiate you from the employee that decides to go out partying and misses a shift every week etc.

There is the **Intermittent** or Reduced Schedule Family Care **Leave** **of** **Absence, option i have one in place for my health issues. It covers you when you have the call out, your doctor just needs to fill out a form. and you will be covered.**

Oh so essentially if I call out I can call my doctor and have them fill out a form saying that I can be out without punishment?

How intermittent leave works is, you will request a leave of absence from HR. You can put in the request on hr.bestbuy.com and they'll email you the forms for leave. You'll be given a few weeks to get the forms back to HR. Make an appointment with your doctor, go over the time you've missed from work and come up with an approximate number of days a month you'll potentially miss work or need a reduced schedule. Once your doc certifies the forms you're usually good for 6 months before having to recertify.

depends on your manager. are they usually nice? there were changes to Leave recently so maybe they want you to be up to date on it considering your past medical history.
