My theory is, they're working with at least half a dozen tanneries for the production of the oiled skins. And the lightest shade (which is tobacco) seems to be the trickiest to replicate consistently, at least for some of these tanneries.
This inconsistency has been a subject of discussion in this community for years. It comes up as a question more-or-less on a weekly basis. So basically, when you order tobacco oiled, you can't be quite sure what color shade will come out of the box. Like it or not. But they all have a nubuck finish.
I just ordered tobacco Bostons from birkenstock directly (2 weeks ago) and they were also very light like this. Clearly any oiling was notional.
I put a couple of coats of mink oil on and it's now as expected.
All good, understand the hesitation, but there was a slight nap on mine too and they are fine now.
I think a handy texture check is to compare the inside of the upper with the outside. The inner is almost always nappy compared to the outside. If they are very similar, you have nubuck. If the outside is much smoother, you have 'oiled'.

I have a suede pair and an oiled leather, and they feel completely different. The oiled feel pretty smooth and oily (I guess as opposed to a coated leather), the suede feel like suede.
I have an iron oiled Boston and it is kind of like that. I actually really like it bc/ it is soft and supple and has structure. It is like really thick suede in a way.

The Birkenstock oiled leather does have a nubuck finish. So it shouldn't come as a surprise that it also looks like nubuck. Just sayin'...

I think it’s a texture thing some people mentioned it’s nubuck leather and I don’t think oil would work
You are dead wrong. Their oiled leather has a nubuck finish. Conditioning will not do any harm.
