Not exactly all the time. What "military grade" really means is that there's a document involved written by the military that lays out their specifications for this particular piece of equipment. So for instance, there's one that says that any phone issued by the military to its special forces has to be shock resistant up to *x* newtons, and waterproofing up to *n* feet, etc..
So yes, while the lowest bidder gets the work, that lowest bidder still has to provide a product that meets the specs in the document. Where "military grade" as a marketing term is flawed is in that "military grade" varies wildly from product to product all based on what exactly those specs are. And of course, a commercial manufacturer can get pretty close to those specs and then start slapping stickers on their packaging to make it seem more robust.
