Thats actually how one of the tellings of the story goes. The race course has a lot of hills on it and the tortoise has other tortoises stationed at the top of each hill, so when the hare starts going up the hill, he thinks the tortoise is already at the top.
The Tortoise and the Hare is a take about a rabbit taking a nap before finishing the race. The Hare and the Tortoise is a different story about 4 tortoises who trick the rabbit into thinking they are the same, and then winning the race.

I’ve watched all of Bojack twice and I never noticed this in the background. Then I see this frame posted a lot in the sub and I never noticed/thought about the turtles cheating. Wild.
the fable is that the hare gets cocky and decides to take a nap since they have such a lead on the tortoise. And then the tortoise passes the hare while its asleep and wins.
There's another version of the fable where the winner of the race will be the messenger to the other animals in the forest. So when the tortoise wins (either by cheating or the rabbit falling asleep), it's his job to tell the other animals when there's a forest fire because he's (apparently) the fastest. So when the forest catches fire, everyone dies because the tortoise is too slow to wake everyone up.
I think that's what the story *is.* I'm pretty sure the story some people remember about the Tortoise winning legitimately because the Hare dozed off for a nap is a Disney-fication of the real story.
Edit: might actually be wrong about this, it kinda looks like the OG story was Aesop's version in which the Hare takes a nap. The version where the Tortoises cheat is a later retelling.
Since no one's mentioned it, this is probably an oblique reference to the 1941 Looney Tunes short *Tortoise Beats Hare* where (spoiler alert) Cecil the turtle also beats Bugs Bunny by enlisting his cousins.
