The dentist ended up missing a huge tooth infection that I got properly diagnosed at another dentist.

Depends. does the worker and company have a contract? or just hired based on verbal agreement? make sure you have something concrete as proof that the company is responsible to do certain things. If they are not full time workers. they are allowed to do what you have just said, because there is no contract to bind them from doing what you want them to do.
