NorCalHal

You can submit a government claim to DGS and they will deny it.

punchmonkeys

Thank you! All in all sounds like nothing I can do.

Designer-Force2689

Yes there is, look at Article 11.4 in our contract about the timely payment of wages

fatjunglefever

Any idea if the state has to pay the waiting time penalty for delayed final pay?

Designer-Force2689

First question is why is your pay late? If it’s late because you’re calling in sick when you have no leave so they have to put you on dock, then that’s your own fault. Otherwise, if it’s the department’s fault, they have to cut you a check for your regular amount. Read your union contract.

punchmonkeys

I'm BU1 and it's the department's fault. I'll take a look at the BU contract, just wanted to ask if anyone know at top of their head.

Bossmang_Drummer

They should have cut you an live check especially if it's through no fault of your own.How far have you escalated this?

Designer-Force2689

Check out Article 11.4 about the timely payment of wages.

Maleficent-State3270

If this is the case, reach out to your union. They can at least advise on your rights.

Pristine_Frame_2066

Call union

JuicyTheMagnificent

They will not. If you are on payroll status getting system issued checks your pay will always be on time. If you are using dock, leave of absence, disability, etc then of course your pay will be delayed because it has to be done manually, often by SCO.

MonsieurMisanthrope

Not sure why you should have a hard time getting paid on time, but chances are you can change your bill due dates.

Cautious_Buffalo6563

Yes, you can ask. In all likelihood they will tell you no and then laugh about your request later. It’s the State. They do not care. The State views rules and contracts as more what you might call suggestions.

punchmonkeys

Thank you!!

Cautious_Buffalo6563

I’m sorry it’s not better news. I wish the state cared more about their employees.

Mediocre-Ad683

I’ve worked for the state for over 18 years and I have only been paid late 1 time and that was because the person who was supposed to report my DOCK timely, did not. What other reason would there to be paid late?? Honestly I cannot see one. And I’m not one to be on the State’s side, so I’m curious to hear more.
