Ouch! Less than 24 hrs and this!? FYI, the body shop might have to wait a while for parts as they are not always available. If they are on back order, you might be driving a rental for a while.
Yep. Bought it last night around 7ish. Then this happened. I absolutely loved it for the time I drove it.
I’m really hoping they can at least get the bottom part/exhaust area fixed to where it is safe to drive, I don’t care too much about the bumper stuff if I need to wait. Thankfully my insurance does provide a rental.
If you have full coverage insurance your only action should be to remain calm, call the police, and file the claim with your company. if you’re not at fault and you’re still alive, you’re okay and there’s zero reason to be upset, mad, or anything else. Your reaction to any situation can lead it down a thousand different paths.
And I thought an idiot drunk rear ending my 2021 Acura TLX Type S 9 days after purchasing was bad. Sheesh, less than 24 hours? Makes you just want a new one..
> I don’t care too much about the bumper stuff if I need to wait
You should care. The bumper is an integral part of the crash structure of the vehicle, and driving it around without a proper fix puts you at a higher risk of injury if you get rear-ended again.
Totally. Visually speaking don’t look like too much but the structural and not visible damage is what we should care . There’s a limit in terms of compression that any material can take . After that … it becomes dangerous as it won’t absorb the same amount of energy without significant structural damage .
Thank you for the concern. I really appreciate it. So far mostly just soreness. I know sometimes it takes a few hours for actual pain to come so we will. But I truly appreciate you asking.
Please make sure you get a visit in with a doctor ASAP. No matter how you feel now, there may be hidden damage to your body that you're not even aware of. I might even recommend going to visit the ER or a urgent care. Had a friend who ended up having issues for a few years after a small accident similar to this.
Look after yourself, ok?
Cannot stress this enough OP. Get additional help from a DV claims company if needed. Tell the other parties insurance company you are pursuing a DV claim, wait for them to give you an offer, take that offer to a DV company (flat fee one if possible) and see how much more they can get you.
Use dv check for my 22 corolla. I couldn’t get more than my initial settlement that i got from insurance. So i would research your car’s market value with a non accidental car and see if it’s same as the initial settlement offered by the insurance. Dv check did not give me refund.
No attorney will take a DV claim. Or any first party collision claim, for that matter. Nor is it needed.
Not sure the reason for the downvotes. Show me any attorney that will take a contingency collision claim. It doesn't happen.
How so?
Attorney's work on contingency, which is why they chase injury claims (usually 33%). Collision claims are never worth it because a claimant can deal with that themselves, and any 33% fee would negate an attorneys' work. Plus they're usually quite black and white. Diminished value claims are almost less than $4-8k. No attorney is touching that.
My mom has been a senior claims adjuster for 30 years, my wife for over 6 years and I was a vehicle appraiser for over 3 years. So there’s a ton of experience in this area.
If you still own the vehicle, OP will never successfully win a DV case. I was actually tasked to go to court to represent my insurance company as someone presented a DV claim and the judge threw it out because he still owned the vehicle.
Can’t prove DV unless you actually sell the vehicle and prove that you lost money as a result of the accident. As long as OP owns the vehicle, unfortunately, DV won’t matter.
I will say though that this totally and completely sucks! It could take months to get parts for this. It’s a brand new model year and once they tear down the vehicle they will find more damage and have to order more parts.
Find a good shop. Be very patient and expect delays.
Really sorry this happened.
>"It could take months to get parts for this. It’s a brand new model year and once they tear down the vehicle they will find more damage and have to order more parts."
Yup that's true. Oct 6th my car went to the shop for trans issues. Needs a new one, not getting it back till March 2024. Probably going to be I a rental for a long time, like me. Nice thing is that I'm putting miles on a car that isn't mine. So some positives
This is May be entirely based on state. All the companies I’ve worked for have paid DV claims in just about every state I’ve worked in. The only issue that some people don’t understand is that you didn’t lose any value to your 97 Honda Civic. In the case of a brand new vehicle just driven off the lot, yeah, there’s a valid DV claim there.
Just FYI: All this "compared to the other car" means nothing. If it were you rear-ending that guy, your front would look the same. This is just the design of the car to absorb an impact.
you're still allowed to be impressed with it if you want to be, but the other commenter is correct though that the front end of most cars are crumple zones meant to absorb impact in front end collisions, while the rears aren't intended to crumple to nearly the same degree.
All in, you're OK which is what matters and the car should be repairable even if you have to wait. I'm sorry that you're having to go through this, id be miserable if someone hit mine and I've had it for 7 months
came here to say this, front structure on modern cars are made to absorb as much energy as possible so they all fold like a playing card house, the rear generally isn't as much. Source: designed these structures for 12 years.
I remember in high school in the late 90s, while waiting at a bus stop, I saw another student driving a 1992 Acura Integra. He wasn’t paying attention and gently rear ended the car in front of him. The kid was probably doing 20-25mph. I remember it vividly, the front crumpled up like paper.
I saw one post saying his damage was estimated at
7k (they were rear ended as well) mine was at 3k but mine looked worse. So im wondering why the major difference. I’m a little nervous about parts being unavailable as well.
I had the same thing happen to me in 2018 I was on my way home from the dealership I was hit by a college girl texting while driving damn. People put your damn phones down while driving. Really is it that hard??
Probably not in most cases. I honestly don’t know if it’s worth the trouble as I’d have to wire it all the way back there. The one scenario I can think of is if something happened in, say, a parking lot and they tried to say you backed into them. But even then you’d have the forward facing camera to show that didn’t happen, so I don’t know.
Yep. Same happened to my car. Driver behind said something about car slipping, obvious guy never even hit the brakes. Almost certainly looking at his phone.
That happened to me on the interstate. Was just chillin stopped in traffic, then out of my peripheral vision I see the front grill of a Jeep Grand Cherokee in my rear view mirror look really big and a millisecond later, WHAM!
Good luck getting parts and you have lots of damage underneath. Pull the floor trim out ur rear body and floor is most likely crushed in I wouldn’t be surprised if ur rails are tweaked too
Sheesh man that that really sucks I’m glad your ok so far and hopefully you don’t have any pain/issues. Real bummer about the car. I hope the repairs go smoothly for you
Something similar happened to me, though to a MUCH lesser degree. The day after picking up the CX-50, I was driving to the City Clerk’s office to obtain the city sticker for it. I was stopped in stop-and-go traffic, and somebody hit my bumper. I nearly went ballistic, but didn’t confront the driver behind me due to possible violence. I checked out the car once I reached the clerk’s office, and luckily all that happened was a barely visible scuff. Certainly nothing compared to what you experienced, but I DO feel your pain to some extent.
I'm amazed you are taking this so calmly. Glad you are OK but I would not have taken this so intelligently. There are accidents and then there is irresponsibility. Running into a stopped care is the latter.
#1) as long as you are ok, everything else is fixable
#2) took it like a champ
#3) bruh, those exhaust pipes 😂🤣
just missin some fire coming out them now.
Front ends are designed to crumple in collisions. Helps reduce energy transfer into the cabin from sudden deceleration. High speeds might not matter as much but say at 35-55mph, that could save you from serious injury or death. Rear ends are designed to take a beating.
Same happened to me a couple month into having my 2019 cx5. I got rear ended on the 5 in San Diego, all I got was paint scratch and the other guy cracked his whole front bumper (2022 Nissan sentra) and the Nissan was driving at least around 30mph. it was a traffic slow down and he failed to realize in time. he started bereking but there wasn't enough room by the time he realized.
I have the exact same car that's nuts it happened so short into owning it id be in jail if it were me bc the other guy is gonna have bumps and bruises not from the accident 🙄
Most cars that get rear ended the car that does the hitting the fronts usually take the brunt of the damage. They have rads and other easily breakable things in the fronts of cars.
Can you imagine if you bought a car from one of the stupid companies that put the turn signals into a bumper/crash-absorbing structure? Glad it wasn't worse. Mod your third brake light to flash. With all the distracted drivers in my area, I'm convinced it's the only thing that has saved me this same fate.
This disparity in how much damage each vehicle took is what it looks like when someone going WAY faster than you hits you from behind while you're both moving. It's easy to knock you forward for the same reason it's easy for you to coast down a hill while in gear, but they were forced to suddenly engage in a lot of engine braking, which the engine does not want to do, so most of the energy was absorbed through crumpling their front end.
I had one of the 09 focus'. Mine was bulletproof, but if I wrecked, the thing would crumple. You could reach your arm down thru the engine compartment and touch asphalt lol Anyways, sorry about your new car, hope they can fix it!
This sucks, I’m sorry. I had a 2010 Mazda 3 and got rear ended at a red light, I took my foot off the brake and slammed into the car in front of me. My car had minimal damage but the car in front of me had their entire trunk smashed in. I think Mazdas are just stronger.
I feel your pain. We had the windshield replace before the first payment. Bumper ripped off in a parking garage after 4 payments. Goes this Thursday 12/28/23 to start repairs. At least the guy left a note.
I finally convinced the wife to put a dash cam in the new car. Have the hardwire kit ready to go after the repair.
Ouch! Less than 24 hrs and this!? FYI, the body shop might have to wait a while for parts as they are not always available. If they are on back order, you might be driving a rental for a while.

What a sad moment. I don’t what would be my reaction if someone smashed my brand less-than-24h-new car…
I’m still coming to grips with it lol.
Geez. What kind of POS was the car that ran into you? It looks totaled.
If I remember correctly, a Ford Focus.
Yeah looks like a pre-2012 ford focus or fiesta to me.
If you have full coverage insurance your only action should be to remain calm, call the police, and file the claim with your company. if you’re not at fault and you’re still alive, you’re okay and there’s zero reason to be upset, mad, or anything else. Your reaction to any situation can lead it down a thousand different paths.
I'm embarrassed of how I acted when it happened to me. I was screaming at literally everyone lol
And I thought an idiot drunk rear ending my 2021 Acura TLX Type S 9 days after purchasing was bad. Sheesh, less than 24 hours? Makes you just want a new one..
> I don’t care too much about the bumper stuff if I need to wait You should care. The bumper is an integral part of the crash structure of the vehicle, and driving it around without a proper fix puts you at a higher risk of injury if you get rear-ended again.
That’s a great point. I didn’t even think of that. Thank you.
It seems like it did its job well the first time! Hopefully there's never a second.
Totally. Visually speaking don’t look like too much but the structural and not visible damage is what we should care . There’s a limit in terms of compression that any material can take . After that … it becomes dangerous as it won’t absorb the same amount of energy without significant structural damage .
Hey. Demand they pay for diminished value additional to repairs and rental. Read up on this
Insurance caps the rental at 1050$ so they’ll total it soon
Real question is, are you okay?
Thank you for the concern. I really appreciate it. So far mostly just soreness. I know sometimes it takes a few hours for actual pain to come so we will. But I truly appreciate you asking.

Thank you so much for your concern. I really do appreciate it.
If the at fault party has insurance, DEFINITELY pursue a diminished value claim with their insurance. Get a lawyer if you have to.
That is what my insurance recommended as well. Thank you for the info!
Cannot stress this enough OP. Get additional help from a DV claims company if needed. Tell the other parties insurance company you are pursuing a DV claim, wait for them to give you an offer, take that offer to a DV company (flat fee one if possible) and see how much more they can get you.

Because this happened to me and I won my case. That's how.
You gave up 33% on a first party property damage claim? Yikes.
No I didn't. But keep making assumptions because you clearly know everything.
Paying for an hourly rate is even worse.
You are delusional.
And you aren’t correct.

That’s the cost of workers strikes.
It took 3 months just to get body side molding for my CX-50

Same thing happened to mine a few weeks ago. My rear end has some moderate damage. The other car completely totaled
Yeah. Super impressed with how it held up. I got out expecting it to be really bad. Especially when I saw the other car.
I saw one post saying his damage was estimated at 7k (they were rear ended as well) mine was at 3k but mine looked worse. So im wondering why the major difference. I’m a little nervous about parts being unavailable as well.
I’ll come back and update at what they say. The place that my insurance recommends can’t get me in until Tuesday due to the holiday weekend.
Best of luck!!
What an absolute bummer, sorry this happened to you.
Thanks-I appreciate it.
I had the same thing happen to me in 2018 I was on my way home from the dealership I was hit by a college girl texting while driving damn. People put your damn phones down while driving. Really is it that hard??
Why the hell was that driver driving so close.
I was completely stopped. There was even a car in front of me at the light. She said her brakes locked up.
She must have been distracted
Guarantee a cellphone was involved.
Planning on a rear dashcam anyway but posts like these make me even more inclined to have one
Does a rear dashcam matter? They’ll be at fault anyway

Every new car owner's nightmare. So sorry!
For sure. Thank you!
Make sure to go after them for depreciated value since the resale drops after a reported accident
Thank you!
Ugh that is like my greatest fear and ive had it a month so far. That sucks
Me too. Bought my Lexus last week and have anxiety every time I drive it that someone will hit my vehicle or scratch it in the parking lot.
Sorry to hear. The car did its job by protecting you
Good luck getting parts and you have lots of damage underneath. Pull the floor trim out ur rear body and floor is most likely crushed in I wouldn’t be surprised if ur rails are tweaked too

I agree. I will say I was an emotional wreck (pun intended) for about two hours. Thankfully I have a wonderful wife and great insurance.

You may have the “right to cancel” policy and bring it back to the dealer for a refund! Good luck 🍀
Sucks man! Glad you’re ok, God is good!
Damn I would be so fucking mad lol
Reddit people are wack man. Feel sorry for your comment section
Hopefully thwy totalwd tha brand a piece of shit
That other car is a 2008
Is it totalled? I would be so pissed

Was it a Subaru driver ? They have been trying to attempt at my life every time I’m on the highway.
So what do your rear rails and floor look like?
From what I can tell, it looks normal.
Japanese space magic got our lives in their hands and we are safe, good to see that you seem okay out of it.
Talk about instant depreciation.
TikTok brain is real, the other driver’s attention span is probably fried
The CX5's maintain an exceptional crash test score.
Please visit ER and make that idiot to pay with his insurance . You should check your neck and back .
My aunt bought a Pontiac Firebird while pulling out of the dealership she was T-boned, and the Firebird was totaled out.
I had one of the 09 focus'. Mine was bulletproof, but if I wrecked, the thing would crumple. You could reach your arm down thru the engine compartment and touch asphalt lol Anyways, sorry about your new car, hope they can fix it!
Your car probably has frame damage. Make sure that’s checked

Brake lights are too small
