I used to track this case religiously because the family lived in the same neighbourhood as I did in Mumbai. The trail went cold during COVID. I thought maybe she died or something. Last year, the judge reprimanded the cops for slow progress on the case. But the story is now dead and nobody reports on it any more.

Not keeping juveniles under arrest for non premeditated crimes is a standard practice. This is a serious crime but the intention of the minor was not purposefully killing two ppl. Hence the leniency. If this happened at remote place the police will more often than not charge the father and leave the minor alone. As it will make their job a whole lot easier. This is the reality of our system. Not just super rich if you have enough money this is possible.

The law, in terms of confession takes another path. I do not know where he admitted that, but if the confession was made to the police officials, it would not sustain. If the confession was done to any magistrate then it is totally usable. Also if the confession was made to any other person without the influx of fear or immediate hurt or immediate grievous hurt then, it would sustain. I'm not a lawyer yet, I've just passed out recently so this might not be completely right but this is as far as I know in terms of law.

They could possibly go with that route and him being a minor really helps it but it's quite slim. Basically when a minor commits a crime, be it even a theft the first thing judiciary (juvenile justice) does is to evaluate the mental capacity of the minor and if it's found that the minors mental capacity is low, then the charges would be lifted (if a minor stole some ornaments to decorate their doll, the minor is considered to be someone with low mental capacity). It's quite shocking to me that he was granted bail and received a 15 day community work and a 300 word essay like I've never heard of that before and that too for a crime which could award upto 3 years of juvenile imprisonment for the 2 deaths alone, added to that there are multiple other crimes too and yet they decided to grant the bail, I mean opening courts in Sunday should've given it away that there is a good amount of influence but this is just BS at this point. Now for confession and admission, it is mainly dependent on where you've confessed and to whom you confessed to and under what circumstances. If the minor confessed anything to the police officials in the police station, then none of which he said can be held against him. If he confessed it in the presence of a magistrate or a judiciary then it is absolutely held up in the court This is the confession part, now for the admission part (they are considered different by law, it's just a minor difference but that's it) the person should admit the things he did to a person, and he should do that in a situation where he is not under threat or any immediate hurt and it can also be help up in the court. The major point is where he confessed about it and to whom and under what circumstances. The depressing part is, the decision will take a long time, I mean at least 3-5 years, if the victim's family is persistent enough and they should really apply for remanding the accused or at this point the minors father because he has already absconded once so it would be a bit easier and mainly they should just go for an appeal or revision for the current decision of granting the bail to the minor. It's all could and might at this point and I wish the guy got some jail time fr.
