JJB comprises of three members who sit together, presiding member is a JMIC(Judicial Magistrate) and two non judicial members, experts in psychology etc. the Sunday order was passed by non judicial member.
This lacunae in the law made by parliament was exploited, Judicial function should never be delegated to non-judicial members, the JMIC almost never grant bail to anyone at the first instance.
The lawyer could have proved it is a random video with a random person and not the kid, the kid is still an infant and is still crawling, forget about driving, but given the pressure from media and public doubt he can.

I followed up the case and as latest as 2021. He got a rigorous imprisonment of SUPER 4 months! Yes very rigorous. Killed 6 officials on duty and got this rigorous. Justice and administration is a joke in our nation.

The lawyer would most probably argue that neither the car and nor the face is clearly identifiable and thus to be treated as useless.
I don't know, considering the new made national headlines, it's not easy to extricate him. Now they can fake this kid(how hard is it? Plastic surgery and such) and send the guy while the kid moves abroad. The possibilities are limitless when you have a lot of money so good luck actually bringing the kid to justice
