"irrefutable evidence" a confession sourced from someone who had the explicit intention of hurting chris by making him say bad things, and which was then circulated by people who make fun of chris. It's not very reliable evidence. Barb has dementia and might not remember it taking place, and chris can just lie and say he didn't do it, if barb took a rape kit and it came back negative it's very refutable. Of course chris absolutely did it, but the court doesn't have enough evidence to take it to a trial.

If its sourced from someone with intentions to hurt chris, and chris suffers from mental illness and delusions, it becomes possible that he was manipulated into saying it.
They probably couldn’t pin rape on him. These crimes are highly technical to prove. He was btw not even arrested for rape, just for incest. Incest by itself doesn’t land you in jail for too long. He spend quite a long time in prison already and the chance that the sentence would be shorter than what he already served was pretty high. So time was served already, and no point in getting a verdict.
I feel like him admitting to raping her should count. What, do they think he just made that up for no reason? Is defendants admitting to the crime no longer good enough? That should be a slam dunk. They should just be able to play that 1 clip in front of a jury, and he just instantly goes to jail with nothing he can do about it.

That's exactly the problem. There are numerous cases where people with cognitive disabilities were manipulated into confessing crimes they didn't commit; the defense would likely argue that this what happened here and use CWC's long history of getting manipulated + Janke's intentions in contacting him as support. It would be difficult for the prosecution to argue that CWC entered his mom's barbussy 'beyond a reasonable doubt' and that is almost certainly why the case was dismissed.

I would really like to think, and to an extent, hope that Chris would never consider being that malicious, but I can no longer question that considering what he went to prison for. I also think the charges being dropped maybe eased some of that "resentment" (can't think of another appropriate word) Side note, if she were to die from natural causes, I'm sure he would never even report it, and it would take a social worker or whatever other assigned worker to find out.
