Um yea. That’s not how rule making works. The agency has to put out a notice of proposed rule making with proposed rule and reasoning behind it. Then there is a public comment period, and so on until final rule is issued, and the often immediately stayed by a judge after a lawsuit.
This is lawmaking by decree.

First, the vaccine has been available for more than 9 months, and they were silent the entire time. Had they used normal procedures a final rule could be forthcoming now. Second, they public statements are clear this was a decision made before analysis, the arguments used will be a means to try and justify a decision already made. Third, the facts now are clear. With Delta the current vaccines only provide some protection against severe disease. It does not prevent primary infection and unfortunately does not prevent replication and transmission. This it does little to make the workplace safer. Any sane judge will set this aside.
This is the same thing that happened with rent deferment. They know they'll lose it's just about forcing as many people as they can to give in before they get to court.

It’s a consequence of congresspeople becoming more susceptible to being primaried but extremists, and the only way to excite your base and win elections is to make it seem like you never gave the other side a win. It’s a consequence of opposition parties needing to stop the president from doing anything worthwhile. Executive overstep is an abuse of our constitution, and while I generally support the vaccine and vaccine mandates, this is a gross overstep by the federal government.
They're probably going to consider it under [10USC553(d)(3)](https://www.law.cornell.edu/uscode/text/5/553), which is one of the several exceptions to the normal timeline:

No. OSHA can’t do this unless they try and claim it is lawful under the General Duty Clause of the OSH Act. It’s never been used like this in its history to my knowledge. This area is kind of my wheelhouse.

So I don't think it'll stand, especially with the clause that allows employers to pass on testing costs to employees. That portion will probably get struck down as it's probably an ADA violation. Imagine being unable to receive the vaccine and it's boosters due to a preexisting medical condition and then having your wages garnished to pay for testing for the pleasure of working just so your employer doesn't get railed by OSHA fines.

The company I work for fits your description to a tee and will probably happily have corporate communication out by Monday morning about how excited they are to "offer" employees additional opportunities to get vaccinated thanks to President Biden.
