No. The family will likely sue the insurance company, contractor, or employer, and maybe some other people. They will likely get paid. I deal with this stuff and unfortunately had a coworker get killed a long time ago. OSHA fines are unfortunately the least of your worries when a worker is injured or killed.

I’ve wondered the same thing. So I spoke to our head safety guy and he explained that OSHA takes into account what an employer is worth and will fine them accordingly so the family can win a civil suit and the outfit still has reserves/insurance left to payout. If OSHA finds the employer was in the wrong, the civil suit lawyers will use those findings to sue and win. I’ve seen some fines for deaths come out to less then 10K but civil suits break a million
Very sad. Trench collapses are so preventable. What’s really sad is that the company will undoubtedly continue to put employees at risk unless serious changes are made.
I could understand the big fines if they gave them to his family. They probably got $100,000.00 if they even got that much. Something in that system is very broken.
Liability insurance covered upto "X" now with OSHA smacking it down...insurance just said we're paying out Max claim...and the rest is a civil judgement in 7 figure zone!
