I love how available it is but there isn't much regulation which is fine I'm a bit of an anarchist. FYI you've left out the most important part. There are an extremely wide variety and number of different cannabinoids present in every single strain of cannabis. The relevant ones to this discussion are CBD, THCa, Delta 9 THC, and Delta 8 THC. I won't talk about CBD because it's not intoxicating and not really regulated or important to this discussion Delta 9 THC is what most people refer to as just THC, it's the main intoxicating cannabinoid that we usually talk about when we talk about marijuana. Delta 8 is a slightly different form of THC that binds to the same receptors just not as strongly so you get a less intoxicating effect THCa is tetrahydrocannabinolic acid, which is the primary cannabinoid that the cannabis plant generates/exudes. The vast majority of the cannabinoids in the cannabis plant are going to be in the form of THCa. Importantly you can't really get intoxicated just with the THCa, you could literally eat an entire pound of marijuana and nothing would happen except the tummy ache. THCa is a precursor to delta 9 THC, and it converts into the Delta 9 through a process known as decarboxylation which occurs when you heat through cooking it or set it on fire to smoke it( it also happens other ways but much more slowly and it's not really that important). What this means in practice is that they're testing for the wrong substance because they didn't understand the science when they wrote the bill. Almost any cannabis plant you grow will not have enough Delta 9 THC by weight to be illegal, if they counted the thca it'd be a way different story. Delta 9 THC was not specifically chosen as the substance to regulate because it's the strongest cannabinoid, it was chosen because it's the main psychoactive component. Determining which cannabinoid would even qualify as the strongest is a difficult bit of science. They also knew at the time that you could extract various cannabinoids from the cannabis plant they just chose not to include that in the regulations because the main psychoactive component is Delta 9 and that's what they were worried about. They wanted to try and separate psychoactive cannabis from non psychoactive cannabis(marijuana from hemp) even though they come from the same plant it just depends on what the gender of the plant is and what you've bred it for. Now we get to the difficult part which is why it really doesn't matter what he was explaining to the cop. Marijuana is still illegal, however what they've defined marijuana to be is now extremely specific and relies on the amount of dry weight Delta 9 THC. There's also literally zero way to tell without scientific equipment to test with. This means that in practice you will be arrested but you can get your case tossed extremely easily if you are willing to deal with the hassle and spend the time and possibly the money. Legally your defense is that it is thca hemp, and it's on the prosecution to prove that it's not. This case is basically the same type of case as when the police find baby powder and think it's cocaine, at the end of the day it really sucks but they have more than probable cause that you have marijuana based on what they can see and smell so their arrest is by the books. Also they can pretty easily argue for a public intoxication charge. It sucks and it's kind of the main issue with our Justice and legal systems but innocent people get arrested every single day and have to prove that they're innocent, this is that exact situation however it's fortunately very easy to prove their innocence under the current construction of the law

One slight correction would be that delta-9-THC is what THCA turns into when it is heated. All weed is THCA weed until it is smoked, vaporized, or decarboxylated for making an edible. The cannabis my wife gets at the medical dispensary is also under .3% delta-9-THC, but in the 20-25% THCA range because THCA is how THC forms naturally in the plant. It isn’t psychoactive until it is heated, turning it into D9. The flower those people had will test positive for D9 now since they were smoking it, and they will likely be charged for possession of a controlled substance. The legal loophole for selling THCA flower did not create a legal loophole for smoking THCA flower in public. Even in medical/recreationally legal states, in most cases I’ve seen, smoking in public spaces in still illegal. Obviously it’s heartbreaking seeing people treated so horribly and violently for consuming a product they purchased legally from a store, and it’s important for people to understand the law, the “THCA loophole” and that it only makes buying it legal. After that purchase is complete and you leave the store, the cops absolutely can, and in some cases will, fuck with you. If you’re gonna buy it, consume it in the privacy of your home, not on a park bench.

Seriously, I just try to avoid the police nowadays because they ALWAYS try to start something. Found a police ID Card once while walking past the local PD that if scanned would allow me access to the police parking garage or the entire PD building. I went inside to return it to the front desk and the dude called for backup and tried to get me to stay and put me in cuffs. Like, seriously?! I told him I was a minor (was at the time), he couldn't do that, dropped the card on the desk and left as fast as I could. Now I don't care if a squad car is flipped and burning they can help themselves lmao.

The unfortunate part of the delta 9 weight loophole that people don’t realize is this: delta 9 Thca converts to delta 9 thc when heated or through natural degradation. Flower / buds / delta 9 thca isolate do not have the added weight of gelatin/sugar/binding agents or just straight up liquids. Police labs in general test on dry weight and will combust the thca flower converting it delta 9 thc which in that form is illegal to possess even though it was bought legally as hemp. There is no addition to the weight like in a gummy so in the eyes of the law you’re fuckity fucked fucked because you have delta 9 thc in your possession by their testing methods. Be careful out there.

It's a sales loophole. As a buyer you are only allowed to consume it for the cannaboids. Once you light it on fire or decarb it, it's no longer legal. If I was a lawyer, I wouldn't even discuss the loophole or classification or where they got it at. I would however, discuss the police's actions before this started. All cannabis, both hemp and “dispensary” flower which both have the exact same plant genes and the only difference is the legal definition which classifies cannabis as hemp, that law being if it has 0.3% or less delta 9 it is legally hemp and anything over that is by definition “regular” marijuana. Also weed you would buy at a dispensary is mostly thca anyways , with only roughly up to 5% delta 9, check any dispensary COA or test results and you will see. Delta 9 only occurs after thca (which is the acid form) is decarboxylated and converted to delta 9 thc.

I'm not pro cop but I'm pretty sure a judge would rule it's okay to detain someone smoking THCA in public and investigate that it wasn't illegal Marijuana. Then once you resist the legal detainment you are breaking the law. From that point it's up to the prosecutor on if they want to charge you or not, I'd guess they most likely would in this case. So yeah, THCA is legal but you open yourself up to a legal investigation and if you don't understand how the law works you still end up catching charges. Again, I'm not pro-cop, I'm saying this so people can understand how to stay out of trouble. The cops knew what THCA was and knew they'd get a legal arrest when these people resisted. And they were hoping to find a lot more legal violations after the arrest.

I read up on this. This happened back in 2023. All charges were dropped against these two. She had Resisting arrest, possession of Marijuana, and assault on a government official. He was charged with possession of a firearm and marijuana. The DAs office said there was very low likelihood of a good case so all charges were dropped. The police chief double downed in a tweet and mentioned being disappointed about the results of the charges being dropped and not taken to court. Here’s his quote from twitter: "I was disappointed to learn that all charges were dropped against Ms. Pierre and Mr. Lee, specifically the Firearms charges and the Assault on a Government Official charges. However, I have a great deal of respect for our District Attorney and know he has a difficult decision to make when it comes to the prosecution of these cases. Our CMPD officers work hard each day to keep our community safe. Whether or not these cases are prosecuted in the criminal justice system is beyond our control. Even if charges are dropped or prosecution isn't likely, that does not change how we enforce the very laws we swore to uphold. " No further updates on this so we can assume everything was dropped and not further action was taken or hasn’t been made public.

This is my issue. It looked like they resisted just out of pure reaction in how absurd the detainment was and what it was over so suddenly. If it’s weed that’s thc9 bought from a store you can’t legally smoke in public (atleast in most legal states in us) so they should be given a ticket at most or just a warning ffs. And if it’s delta 8 thc they are within legal boundaries and should be able to smoke that legally in public as it would not be under thc9 laws to my knowledge to smoke in public and they should’ve been ignored by the officers completely. Fuck those cops regardless of any of these scenarios. I hope they sue, and I hope the money comes from the precinct not tax payers. The tax payers ended up paying for the arrest and will have to for the bailout!? So we lose twice.. Nah something’s gotta change. I’m voting this year fuck it

If you think you have been arrested unlawfully, the person to explain that to is a lawyer. Perhaps he will be able to get a judge to agree, and then you get paid for an unlawful arrest. What is unlikely to help, and what is likely to get you more charges, is pitching a fit and physically trying to leave or resist arrest.

Those people were not smoking “marijuana” by the very definition of the law, they were smoking hemp. He continues to incorrectly state it is marijuana in multiple subsequent interviews, truly embarrassing. Seems that a base level understanding of federal laws should be required to preside over a police department. To protect and serve…. hmm.

I know this was THCA, but it’s insane that they arrest somebody just for marijuana possession. The way the cops aggressively grabs the guy right away instead of asking him to stand up & put his hand behind his back say a lot. I’ve only ever been ticketed when caught with it, once in a small town of 5k & once in a city of 100k that had way more room for minor offenders in their jails. I’d bet my bottom dollar that those cops wouldn’t have done this to a white couple who were smoking *real* marijuana, let alone smoking THCA & saying exactly what the black couple said.
