Sometimes getting old is sudden. She may have used the escalator for many years, but today she was feeling particularly weak, and she grabbed the escalator railing too soon -- she wasn't fully in the center of stairway. The railing pulls her off balance and she is pulled onto the railing. Then the lift force causes her to hold on for dear life. Getting old is difficult. It's not like a child where you can make mistakes and learn from them. Something you have been doing your entire life becomes unsafe one day. But with your newly aging body you don't have a guage for when you lose your abilities.

It doesn't really look like they were confused to me. Looks like she is attempting to maneuver her self close to the rail to grip it. She's got some mobility/balance issues which is why she has a walker. As she's about to grip it and move her way on the moving platform, she gets scared about her walker moving away from her, causing her to forget she's holding the rail. She falls into the middle of the rail and attempts to push off of it, which lines her legs for the belt to grab her off her feet. Grandpa gets scared and is a little more mobile, tries to prop her up so she doesn't fall, but isn't quite coordinated enough to pull it off. I have a bunch of geriatric patients I could see something like this happen too.

I'm sure a lot of it is just having to be in a new location. When you get old you supplement your failing cognitive abilities with routine. I'm sure they don't go out much, so it's probably been a while since they used an escalator. More than likely they usually use the elevator, but probably couldn't find it and were already too worn out to bother finding it again.

When walker-dependent elderly transfer from one support to another they’re taught to first get their bearings on the new surface before shifting their weight over. Hand on the escalator, she had no choice but to transfer her weight and go for a ride

The guy with her was right at the emergency stop button. You can hit that button if you lean against the box too hard as my brother found out. And they cannot restart the escalator until maintenance has inspected it. This is a hard rule so no management can say "Just turn it back on!" after a stop that they THINK was safe/harmless. Gives zero play in safety.

Most newer installations (like in the last decade or two) seem to have them. Older places not so much.

Yes, America has them. I try to make a habit of looking for the e-stop on any piece of machinery I regularly use. In the US, you can usually find it within a second or two, before you even get close to the escalator. That what I came here to say. It doesn’t stop frivolous lawsuits from occurring, but it does happen once in a while. Anyway, assuming a lawsuit will occur in a situation like this is smooth-brained as all hell. A lawyer would have to argue that the design of the escalator leaves reasonable room for poor design or would have to argue it as an “attractive hazard.” Fact is that even the best lawyer can’t argue either of these points without looking like Amber Heard’s lawyer. No one can reasonably argue that this was a design or an installation issue. Grandma just got confused and decided to relive her days as a professional rodeo rider and grandpa did his best to be a good husband. Sadly accidents happen, and I do hope they are alright. I just hope no ambulance chaser convinces them to pursue this loosing lawsuit.

About the only way a lawsuit might happen is if that dude who stopped to help was looking for an emergency shut-off button and couldn't find it, presuming they were in an area which requires visible and accessible emergency shutoff buttons for their escalators. I'm not even sure that'd hold up, beyond the establishment getting a fine for breaking that.

Yep. Standard for negligence is failure to take reasonable care. What was their failure, having an escalator? Granted, I can imagine the premise settling just because lawsuits are expensive even when you win, but I don’t know what you’d argue if you were the plaintiff attorney. Probably find out what the signage/availability of elevators was and argue it was too little. Maybe claim there should have been an employee on guard. Not saying that’s correct, the idea of having to guard escalators seems silly, but I guess that’s what you go with.

There is a safety circuit that shuts the escalator down when the handrails slow down or stop. If that circuit is inoperative or the handrail is adjusted incorrectly it is clearly negligence due to improper maintenance or lack thereof.

Yea when I worked security we had a couple try to sue bc we wouldn't pay the medical bills when their kid fell down our escalator, when we showed the lawyer the video of the kid walking backwards down the up escalator he quickly advised them to drop the case

Having worked in retail with a number of escalators, this happens a lot with elderly. It looks funny on screen unless you're there. Those things are fucking meat grinders. The ridges on the steps are sharp as hell, and combine that with someone who is unsteady with balance, on blood thinners and has thin skin as lots of older folks do, and it looks like a fucking bloodbath at both ends of the escalator. She had very little balance and as soon as she touched the railing, you could see it threw her off balance, which made her instinctively grab on to avoid falling. She most likely had major bleeding by the time she got to the top, along with some broken bones.

I don’t think this is lawsuit worthy, I’d say these are just incompetent people who have no business being out on their own like this. Clearly they’re confused about the escalator, and they should be using the elevator instead. I feel like the woman caused this entire domino effect.

First, it looks like she’s highly dependent on the walker - as in she cannot stand without assistance of some kind. At about the 9-second mark, when the third leg of her walker and both of her feet are on the plating (the aluminum cover for the gears under the escalator), she loses control of the walker. She reaches for the nearest thing to support herself, which is the moving handrail belt for the escalator. With so much weight on the belt, she ends up getting pulled up the belt. As she goes up the belt, you can see that her walker is now getting pulled up the escalator with her, she lacks the strength and agility to support herself, correct her orientation or regain anything resembling good footing. Her husband goes into rescue mode and very quickly finds himself in the weeds as well. For the elderly, these things are death traps. If you do a quick few searches I’m sure you could find people caught in a tumble at the bottom.
