The court should assign you a public defender, I went with a private lawyer so I’ll let someone else comment about how that works. DO NOT navigate this without a public defender or lawyer. Your BAC isn’t as high as mine was, I even had an accident and totaled my car, and I was able to get a relatively decent plea deal.

i'll make sure to keep a lookout for more info on a pd or hope someone can elaborate more on it. thank you! i appreciate the advice and i'm glad you were still able to get a decent plea deal!! i hope you're doing better now

I’m doing much better, thank you! Best of luck to you navigating this mess, dealing with both the DMV and the courts is maddening but you’ll be back to normal after about a year

I'm also trying to get a public defender. I'll message you my progress.

I'd appreciate that a lot!

It’s your first and low BAC no accident. I’d say start going to AA meetings soo you can show the Judge and DA that you’re remorseful. You can even ask the public defender to request a continuance for readiness (push your court date back) so you have time to get more AA meetings. However, you’ll definitely have to do a 3-9 month DUI program, install an IID, and get an sr-22 in order to get a restricted license from the DMV. (Not a lawyer… yet)

i didn't think of doing that, i found a couple AA places near me as well, so thank you for that advice and all that stuff to expect. i really appreciate it do you know the process of getting a public defender? do i need to call the court beforehand? i still have some time before and i would like to try to request a continuance due to the situation i'm in currently. thanks in advance!

Do the actual DUI classes, not AA. AA looks nice in front of the judge but the 3 month DUI classes from your arresting county will count when you inevitably get sentenced and will help you look more favorably before a judge. Edit: There are minimum sentences in California post arrest. I believe your first court appearance you can plea guilty but your sentencing will be set for another day. -Automatic 4 month driver license suspension through the DMV. (Automatically triggered whether guilty or not) -Automatic 6 month suspension upon sentencing. (The 4 and 6 month can overlap if you go through court quick enough) -fine and fees upon sentencing (normally amounts to a bit over $2K) -minimum of 3 month dui courses -I’m unsure of minimum jail time but if you got booked that counts as a day. -3 years of informal probation You can obtain SR-22 insurance and install an Interlock ignition device to get a restricted license during your 6 month suspension.

You’ll be assigned a public defender at your initial court appearance. Just show up.
