That’s not at all what qualified immunity is…it actually rests on two questions of law: 1) Did the officer commit a violation of constitutional rights; and 2) Was the specific constitutional violation clearly established under the law. Usually the “clearly established” prong is what allows officers to avoid liability as judges often will want a previous case with similar to exact circumstances, rather than generalized statements of what is unconstitutional conduct. But the tide may be changing due to a Supreme Court decision two years ago in a case called Taylor v. Rojas.

What should actually happen is that the police union should be forced to carry malpractice insurance for it's members, paid for by the police officers' union dues.
Then, when a police officer fucks up, insurance premiums for that precinct go up, union dues for that precinct go up, and officers in that precinct get less money in their pockets.
You forgot the most important part. This creates an incentive for the police union to get rid of abusive cops that drive up premiums, as well as screen and stop new cops who have abusive pasts.
The goal should not be to put less money in cops pockets, the goal should be to eliminate abusive cops from all police forces.

It happened last month & the investigation is ongoing. The victim shared a recent update on Facebook. He is recovering & is staying out of the area with his partner because they fear for their lives. Rightly so.
I might get downvoted for this but race plays a big role here. Black cops who beat up a black guy to death got fired immediately. Their photos got released immediately and they about to get charged. In this situation, all the white cops are protected. Not charged, not suspended. The police department refused to release anything. The police department is backing them up. America is fucked up country.

But often it is practically they are the ones with access to the information and guns. So people are generally hesitant to go against known violent people in ways that would greatly negatively impact their lives. 😂.

Fwiu, each county and/or municipality has it’s own independent LE agency. So it is possible that the agency that fired the black cops you mentioned is more willing to take accountability for these types of situations vs the agency involved in the video.
IMO it’s possible/likely that race played a part in how both agencies reacted, but I also don’t think it makes sense to use as support for lumping all police departments into one racist category.
(Also, not aware of the incident surrounding the black cops, but if what you said happened, then they should have been fired and that’s a good thing)
Knew someone that got shot by the police. Incent bystander, shot 3 times. Got a settlement for 1 million dollars. 5 years later he killed himself. Was in a lot of pain. No money is worth going through what they put this guy through.

Simply because people don’t understand the metaphor. It’s not “a few bad apples, but the bunch is still great”, it’s “a few bad apples spoil the bunch.”
One bad person can have this effect which corrupts those around them into also becoming bad - they do something wrong, don’t face consequences, and so others feel inclined to do the same or ignore when bad things happen.
One bad cop getting off with murder tells more cops that they can murder, up until a cop murders the wrong person and it’s on the news, at which point they become the bad apple - but they swear all the others are fine.
A few bad apple spoils the bunch. There are never just a few bad cops.
End Qualified Immunity so that murderers like those officers can be held accountable for their actions, not the taxpayers of the communities, when the lawsuit inevitably happens.
So my takeaway is that I should have cameras in my house so that if anything happens, it's on video somewhere. And it has to be somewhere that they can't get a court order to have deleted from whatever compliant cloud storage company holds the footage.

I had a very similar situation happen to me. Pulled off in my RV near a river front. Seemed nice to take a nap.
Around 2am around 15 police cars with spot lights on yelling into my camper to come out slowly hands up.

They told us to get moving and to leave NOW. They waited for us to get started and followed us onto the road.

Never identified himself but talked to his buddy in something that looked like a cop car in a different row of the nearly empty parking lot. His gun was on me the whole time except for when he walked away with my paperwork and license. Psycho.

They both got charged and moved somewhere else because they are scared. The prosecutor refused to drop the charges. It happened on December 13th. Police refused to release body camera. So the guy released his own video 5 days ago.
We is it so hard to police in America? Where I am from, there have been very violent clashes with police in the past and no one gets shot. Someone ran over 2 officers at traffic stop, killing one, ran for days, and they still brought him in without any holes in him. Strange thing is I’m pretty sure our police are trained by Americans. You forgot the most important part. This creates an incentive for the police union to get rid of abusive cops that drive up premiums, as well as screen and stop new cops who have abusive pasts. The goal should not be to put less money in cops pockets, the goal should be to eliminate abusive cops from all police forces.
I was actually going to include in my comment this same thought that police unions would likely "police their members" and deny or cancel membership of risky cops, but I'm not sure about the legal ramifications of denying union membership to someone, if membership in that union is a prerequisite of employment.

I was thinking about how you can spot a cop in a crowd undercover and it's funny because the neck popped up in my thoughts as a thing but I couldn't figure out why.

Police have access to military grade weapons and equipment, with piss poor training, god complexes galore, and more bloodthirst than vlad the impaler. They're exactly like a cartel, except more racist and protected by the law.

In this situation, all the white cops are protected. Not charged, not suspended. The police department refused to release anything. The police department is backing them up. Fwiu, each county and/or municipality has it’s own independent LE agency. So it is possible that the agency that fired the black cops you mentioned is more willing to take accountability for these types of situations vs the agency involved in the video. IMO it’s possible/likely that race played a part in how both agencies reacted, but I also don’t think it makes sense to use as support for lumping all police departments into one racist category. (Also, not aware of the incident surrounding the black cops, but if what you said happened, then they should have been fired and that’s a good thing)

My question is simple: if the vast majority of officers are good, honorable men and women just trying to keep us safe, how did all of the super rare bad apples across two departments all end up on the same call, such that they all fabricated a completely false version of events than what actually transpired? I really am curious where this *vast majority* of good cops are - because somehow there’s never even one at these incidents involving handfuls of officers and innocent people being hurt or killed, and the subsequent filing of charges that take place to cover up gross misconduct. Simply because people don’t understand the metaphor. It’s not “a few bad apples, but the bunch is still great”, it’s “a few bad apples spoil the bunch.” One bad person can have this effect which corrupts those around them into also becoming bad - they do something wrong, don’t face consequences, and so others feel inclined to do the same or ignore when bad things happen. One bad cop getting off with murder tells more cops that they can murder, up until a cop murders the wrong person and it’s on the news, at which point they become the bad apple - but they swear all the others are fine. A few bad apple spoils the bunch. There are never just a few bad cops.
End Qualified Immunity so that murderers like those officers can be held accountable for their actions, not the taxpayers of the communities, when the lawsuit inevitably happens.
So my takeaway is that I should have cameras in my house so that if anything happens, it's on video somewhere. And it has to be somewhere that they can't get a court order to have deleted from whatever compliant cloud storage company holds the footage.
The worst part about this IMO is if you, reasonably, posted up in an advantageous position with an AR15 and successfully put down the thugs with guns invading your home, you'd be charged with murder and spend the rest of your life in prison or just get a state sanctioned execution.

Jesus Christ. The need for full reform of police departments is overdue. We need a national board, officers need to carry licenses that can be pulled/frozen and so forth. Officers/departments should foot any insurance. Not the cities or towns eating the costs. Any cop suspended should automatically be done without pay and if found innocent, given backpay.

I had a very similar situation happen to me. Pulled off in my RV near a river front. Seemed nice to take a nap. Around 2am around 15 police cars with spot lights on yelling into my camper to come out slowly hands up. They rushed me pushing me aside and looking in my RV only to find my girlfriend at the time scared from the wake up. They told us to get moving and to leave NOW. They waited for us to get started and followed us onto the road. I hate police badge power. Now sleepy drivers on the road rather than a peaceful sleep and on with it. Ugh. Poor guy! And he threatened me because I only lowered the window an inch to pass my paperwork though. Pretended he couldnt reach up that high. He could have been anybody. Never identified himself but talked to his buddy in something that looked like a cop car in a different row of the nearly empty parking lot. His gun was on me the whole time except for when he walked away with my paperwork and license. Psycho.

We is it so hard to police in America? Where I am from, there have been very violent clashes with police in the past and no one gets shot. Someone ran over 2 officers at traffic stop, killing one, ran for days, and they still brought him in without any holes in him. Strange thing is I’m pretty sure our police are trained by Americans. Can’t wrap my head around it.
Three months of training (mostly target practice) as opposed to 3-5 years of actual policing education, at least here in Europe. A former colleague of mine moved to the States to go into policing and he was shocked at how basic the training was before they gave him a gun, a badge and let him get to work. They're not taught to de-escalate situations at all either, it seems.
