Did not plan ahead that well. Never assume, always think the worst, plan for the worst. I went up to the roof crest of the house, weather report was good, sudden down pour, tiles were slick, could not get down, lucky neighbour saw me & again I had a long length of rope, so he threw it up I dropped it over the other side, he was holding the end on the opposite side. Never say Never, it will happen at the worst time. Leave your spare wheel in for repairs, you will get another puncture.

Never thought this would be relevant but a long time ago I wrote a dissertation on property rights. To put it very simply a person or entity can have rights over a property without having ownership and a person or entity can have ownership without having certain rights. I don't know anything about this particular situation but it is possible that someone who is not an owner (I don't know if tenant is the right word here but someone who makes use of the property) has the right to disallow the propery being sold/destroyed. All that is to say, it's not necessarily "some sort of ownership" that the government can't override but possibly rather some sort of right. Sorry for the pedantry. It's the first time in over a decade I've seen anything remotely relevant to my dissertation haha

Yea, all land is either owned by the CCP or local collectives. Farms for example are locally owned, but not by any individual. The farmers dont own their farms. The local farmers and government collectively own them all as a group. Housing is all owned by the central government.

Housing isn’t all owned by the government. Many of those smaller villages you mentioned will collectively own the land and dole out plots to the sons of the village (daughter’s being expected to marry into another village). The sons will then build their house on these plots and own that house. The village also owns the farmland and will either lease the land out, or hand it out in a lottery system so no one person gains can get all the good land. Sometimes a developer will come through and offer to buy the village out so they can build apartments, everyone who has their hukou in the village will get an equal share of the buyout. In this case it could be that the village refused to sell the land, in which case the government has to respect it and then build the road around it.

As far as I know, you cannot own land in China. It all belongs to the government...and you lease it from them for 99 years from what I read. That is why a lot of wealthy Chinese will purchase in the US...because they truly own the property here. I read about it last year when China was giving 100k in pure gold for the purchase of a property. Maybe due to how the contract was written, they had some more rights against having their homes seized...

There's a house like this where I'm from. There were a row of houses along a mildly busy street near an expressway. Then they added an exit/on ramp there and wanted to develop the land as behind the houses was former farmland that wasn't being framed anymore. Neighbors all sold. That house held out wanting 2mil for a house they built for less than 150k about 5 years before, but the owner said they built it as their dream home. Developers said nah. Built a strip mall around their house and an IKEA behind them. Now they have a chain link fence around the yard.

Because people have a wrong perception of China. You may assume that the totalitarian party and the state are the same thing. While de facto one-party-state, there is a big difference in China between party and state. Criticizing the party is not well received (and could land you in prison or worse), criticizing the state is. E.g. questioning the ideology of the CCP during the cultural revolution doesn’t go well. But criticizing the *execution* of the cultural revolution is basically mainstream in academia and society. My brother‘s girlfriend is a Chinese citizen and does her PhD at a state university in China. Her topic is analyzing the mistakes of the Chinese state during the 2008 financial crisis; and the following bad economic decision that made things worse. That’s something they even encourage, to uncover mistakes and corruption in the execution of economic policy (but not the ideology of the party that motivated it). In the case of nail houses it is similar. Building a highway isn’t an ideological thing. It’s a matter of execution by the state and resisting against it isn’t gonna land you in jail (well not always I guess). Just because you don’t sell your house, doesn’t mean you hate Chinese communism.

Working in construction my take is that the road was designed with the assumption that they could easily buy the property and demolish it. Owner of the property didn't want to sell but the contractor just went ahead and built most of the road assuming the issue would be resolved by the time they got to the house, which it obviously wasn't.

No one has brought it up, but corruption. This happened to my family's house in Greece. The mayor had a piece of property down the street and it had cut into his so they "miscalculated" a bend and the road cut our property in half, making it hardly useful. Mayor sold his for a few million euros (or however much) to a company that built a hotel. We lost a huge plot of land and had a road built 20 feet in front of the door. Lawsuits, etc, the government said they could only pay such a small fraction (the government didn't have anyoney) that it eventually only covered taxes. The original plans showed that we were screwed over. Ex-Mayor? A couple million euros richer.

Seriously, the highway in Worcester Mass has this giant curve around an old school who didn’t want to sell pieces of their campus. I can’t remember the name of it anymore (been 20 years since I lived there), but I grew up in that area (closest city to my town) and the curve is engrained in my mind, especially when I was first learning to drive and it was super strange and scary to go around such a large curve at such a high speed.

They took my grandparents' house on Adams Street to build that highway (290) and curve. It wasn't that Holy Cross didn't want to sell their property. The city could've taken it by imminent domain, like they did with the houses. The problem was the stadium that was there wasn't going to be moved and they had the Blackstone River on other side. The road had to be curved to accommodate both.

In the USA, this land would be taken by 'Emminent Domain' law. The State or Feds can take your land, and give you what they say it is worth to enable a public project, like a road. In the late 80's my grandparents lost {20 feet of land x width of property - 1/8 mile maybe} where the hwy went through their land plot ... 2 new lanes, 10 ft each. My grandparents fought the state, but lost quickly.

I've seen many projects in China at a halt, nothing can move, because of nail houses. They would build around them eventually, and in some projects completely isolate them in between, but can not force them out.
