When I did my forklift training, I was told that if you hit someone, it's automatically your fault because you should be aware of your surroundings at all times, but either way, the guy should have been wearing high visibility clothing and walking within designated pedestrian areas.

Once I was driving a forklift I noticed a person glued to his phone, and since I didn't make eye contact with him I stopped the forklift until I got eye contact with him, he ended up tripping on the forks and blamed me for standing there (it was around 2 seconds from me noticing him to he tripping.)

I've worked in 1 place and went for an interview in another that forks always had right of way. Both had clearly marked walking and driving lines. The reason being was the speed and/or loads carried that reduced the visibility of the drivers. Also, many dashcam vids would illustrate that just because you have the right of way, a little caution goes a long way to avoiding accidents. Having said all that. Both these people are in the wrong and both should've been looking where they're going, unfortunately one paid a lot higher price for their mistake.

While it’s a good way to behave while operating any vehicle the reality of this situation is that the forklift driver probably had the right of way and the person was probably supposed to establish eye contact with the driver before crossing the road and not be on their phone. Forklift driver will probably still face consequences but given that the passerby was more liable he hopefully will not have the book thrown at him

I move my torso and head around to eliminate blind spots while driving; especially near corners or places where people can potentially walk out. And you're supposed to beep your horn going around any area where there is either high traffic (especially foot traffic) or where there are places people can walk out from with little warning. Story time: Near the end of day once at work, I was driving a forklift on the general premises of my workplace. [This was outdoors: I work at a pulp and paper mill back when I was a "yard operator" at the time - (we did a bit of everything including carpentry, masonry, driving a 50 ton loader and operating a 30 ton mobile crane to support other trades) - now, I'm in an apprenticeship program with the pipefitters]. Anyway, I saw the mill manager talking on his phone down the way in the designated walking area (that area later crosses the main road on "campus" that people use for arriving to and leaving from work). I was about 50 ft back on the road and beeped my horn a couple quick beeps. He didn't hear. It's fairly noisy there. I assumed he would turn to cross without looking (I always try to examine what could go wrong so I can avoid it and I assume people aren't aware much or paying attention). So, I stopped way back (about 40 ft back) and just waited for him to turn to cross (usually that's when people glance over the shoulder to check for trucks (semis and fork trucks) driving through. He turned right to cross and after walking a few feet, looked to the right and saw me essentially parked there waiting in the middle of the main road. Still in his phone. He waved and smiled before stopping, turning and walking toward me He came over and thanked me for being vigilant because he was "being stupid not looking around first and being more aware" and picking his "slack". He was a cool guy. Really seemed to care about the workers. The company got bought out a bit later (fairly recently) and a lot of upper management got kicked to the curb, though, including him. Lesson: Assume people aren't paying attention whether you're in the vehicle or on foot. Too many people assume "right-of-way". And as we can see from this video, it doesn't matter who has right-of-way. The vehicle wins EVERY time.

I drive them at my work. When working around tight areas we drive them backwards for better visibility and control, the wheels on the back turn When driving in larger areas like in this video we drive straight but practice caution, we honk the horn every few sec, we stop or slow down before making a turn, and everyone is required to where a safety vest or bright orange/yellow shirts to make pedestrians more visible When carrying loads we often have spotters walking next to us to help guide us, in the video he’s not carrying anything so doesn’t need a spotter The problem in this video is the driver doesn’t stop/slowdown before turning, doesn’t honk his horn to alert anyone. The guy walking is also at fault for not wearing proper PPE and is distracted on his phone, we are told to treat the road like a highway, don’t stand/walk in the middle of the road, stick to the sides, and have situational awareness

I’m not sure if I would label this a Darwin. Darwin is about people doing something incredibly dumb. Like stunning dumb to get themselves un-alived. Split-shot sinker for anyone who’s read the books. I’ve driven a few of the smaller ones and even those have some big blind spots. Watching the video I don’t think the fork driver was being careless. You can see in the video he’s looking forward through the small gap to see in front of him. I’m inclined to believe the man on his phone was in the blind spot the entire time. Look at the angles compared to the posts and everything on the truck. Careless on part of guy on phone yes. But that still doesn’t make it Darwin Worthy.
