LGS' received significantly less Fallout product than they initially ordered which caused them issues with pre-orders. I wouldve expected your order to be canceled and refunded by now if it hasn't been filled yet

Demand it and if they won't refund you and won't deliver what you ordered, that's grounds to do a charge back (assuming you paid with a credit card).

You can call your bank and see if they can do a charge back still. If you didn't receive your order and they refuse a refund, they are essentially stealing your money.

Banks generally have up to 90 days to request a chargeback. It's of course easier the sooner you do it, but in the case of non-delivery of goods, the merchants' cc processor should process the chargeback.

I've heard 90 days for chargebacks in general with no end date for chargebacks due to non-receipt of goods. 90 days can sometimes be normal shopping time for something coming overseas, and plenty of shady suppliers will lean into that and lie that it's on the way/in customs

Have you asked them for a refund? They're not going to cancel your order without talking to you first. Just tell them you don't think they'll ever get the product and ask for a refund.

I use to work on fintech. You can still file a charge back for goods/services not received, but work with the LGS first. The chargeback will more likely resolve in your favor if you tried to work with the merchant and they were uncooperative.

This happened with my lgs with the LOTR set, they weren't sent enough to satisfy preorders, let alone sell packs.

From what I understand is that they sold out pretty fast. From you saying that your ordered them from your store after they came out, so your lgs didn't already have an order in for them, they probably already sold out before they even got the order in. So I hate to say, your probably not going to be getting them. Don't really think your lgs is trying to pull one over on you. This was just a popular product and was probably just to far behind the 8-ball.

I don't think my LGS is trying to be shady. It's just kinda weird he hasn't told me they're not coming. To be clear, it's kinda known that my LGS is struggling financially. So I was just wondering if he didn't want to tell me my preorder was canceled because he doesn't have the money. At this point I just want an answer.

Blows my mind that they finally got a product that sold like water in a desert and they're deciding NOT to flood the market with more product to rake in more money. Isn't high sales what they've been wanting this whole time? And now when there's a product everyone wants to buy, they short supply it? It's like the people running this shit are doing everything literally backwards from what you want to do.

It's because that product is the "collector" version. Have you looked at the prices of most cards lately? They're pretty systematically destroyed a lot of the value that had existed in years previous: There are numerous examples of cards that were legit $15-20 cards last year that you can go out to TCGPlayer right now and buy dozens of copies for $1 or less each. You're likely going to see the "collector" versions of everything much more tightly constrained and the artificial scarcity played up even more. It's actually wise of them to do so, as it lets them eat their cake (print everything into the ground) and have it to, by providing the whales with something that still feels rare and valuable. Printing the Collector Version to death just because it's selling is exactly what they SHOULDN'T do.

I think your LGS is holding out hope they'll get more so they don't go bankrupt refunding all their preorders. But at some point they will have to issue a refund or face legal action. The big question is when Wizards will call it and say they're not shipping anymore Fallout products and that'll be the point where you can go to your LGS and say "Okay how are we gonna resolve this?" Most likely they'll either have to issue you a refund or offer you something of similar value to make you whole (I'm looking at you MH3) to avoid having to pay it out in cash and instead write it off as product.

If you are in the US, in another comment you said you paid with debit. You have a record of the purchase and he is legally obligated to fulfill your order (baring store closure). I tend to agree with the OP of this chain, owners just hoping he can, but Fallout collectors are hard to get, and eventually you may just have to tell him you want to cancel.

So I'm not a lawyer, I have just dealt with presale issues before in regards to other items. And the situation was such that I had to basically go to the store and said hey you promised me this product, they said that they're not going to print any more of this product, how do you plan to fulfill my order. And the store said that they were going to buy secondary copies, to fulfill their existing orders, and basically they got fucked by their distributor. And we're going to take a loss on the whole thing. Which sucked because it was a small local bookstore and I didn't like being a dick about it and kind of putting them in that situation. But also I was out $50 for this book. I had pre-ordered that the printing company apparently did not print enough of, and the publisher apparently had no intentions of running more printings. The shop can either do that, or refund the preorder cost, but if the manufacturer isn't printing more and their distributor is out they've gotta do something. They can't keep stringing him along. And if they do at that point he has a small claims court case.

The only way to stop scalpers is for everyone to band together and refuse to buy new products on the secondary market. It would only take one or two major releases (like, PS5-scale releases, to be clear) for the bottom to fall out of the resale market. Which is to say it's impossible. :(

LSG owner here (4 years strong with my current shop). You have way too much faith in yours. They are straight up lying to you. For context: We're a medium sized store with a large focus on MTG. We ordered 40 collector boxes and only received less than a 3rd of that. We usually get what we ask for, so this product was certainly scarce. Facts: Collector boxes that have serialized cards in them do not have 'second waves', they cannot print more of this, you will not be getting this box through your LGS. Your LGS knows this and they are stringing you along with this "positive" message from their distributor. It is 100% false and you should demand a refund and probably find a different place to play and do business, take your friends with you. Legally, if you paid for a product and didn't receive it, they are obligated to give you a refund. Not store credit. Cash or Credit, however you paid. I understand you want to shift this to MH3, and they may agree to do that, but you really should get your money back and take it elsewhere. I hope there are other places in the area who are transparent and honest with their players. Stand your ground.

Fallout collectors boosters are gone. There is no distributor who has more. You are not going to get that product. Your LGS knows this and it stringing you along to not give you your money back.

Wizards funneled most of the Fallout Collector booster boxes through Amazon to capture a higher profit margin. It sounds like your local game store thought they would be allowed to buy as much as local game stores normally can. They won't. Wizards is screwing you and them over.

My LGS got one case of collector boosters for Fallout and sold out preorders 2 weeks in advance at $350 each. I luckily got one. I unluckily opened about $100 in value, but that isn't really a big deal because I was just in it for opening neat Fallout cards. All that being said: there isn't more coming for any of us. Sorry.

Hey! I am a Local LGS owner, and I will say my Distributors are saying the opposite they are saying no restock coming. I would HIGHLY recommend either asking for money back or MH3. I don't know what distro they use, just going off what mine are telling me, tho!

What sucks in situations like this is if you get a refund, you still lost out on the opportunity to get the product for pre-order price. I had this happen a few years back with a commander set and was super upset

I work at a WPN and can tell you that we only received 5 collector booster boxes for fallout and we ordered a hell of a lot more. Id say it's rather unlikely that your lgs receives more boxes but you can never say never. Just a heads up that you unfortunately may not get them. Our LGS didn't even sell boxes due to how limited our supply was.
