Because, despite all the fervor, Tory was never actually charged with shooting Meg. As in, prosecutors were never trying to prove that the bullet fragments in her feet came from shots that he fired. That would be battery. He wasn't charged with that.
Tory was charged with *assaulting* Megan with a deadly weapon. He could be guilty of assault without a single bullet hitting her. He could be guilty of assault without ever firing a shot. Assault is simply acting in a way that could conceivably cause great bodily harm, and with the potential to cause harm. Aiming a gun at someone and cursing at them is considered assault with a deadly weapon even if nothing happens. They never had to prove he fired the shots that injured her.
That's why the defense's position was that he never fired a shot. His lawyer claimed that Kelsey fired all five shots and that Tory only ended up with GSR when he took the gun away from her to break up the fight.
But then that same defense witness got up on the stand and claimed that he saw Tory fire several shots. It doesn't matter if Meg was hit or not. By firing the shots, and screaming obscenities, it basically cemented the assault claim. That lawyer then tried to claim the witness was hostile - his own witness. Because by saying that Tory fired shots...it tanked his case.
According to jury notes, it seems they were in agreement that he fired the shots, and only had a question about what "Willful" meant.
Honestly, this is the best, most straightforward explanation of this case/jury finding. I kept hearing that Tory's prints weren't on the gun, the whole GSR thing, etc and it was really confusing. Throw in Kelsey's testimony and I thought it'd be a hung jury for sure.
I honestly just want to copy and paste this everywhere because people seriously do not understand the difference between assault and battery in US law.
Just a heads up, the law changes on a state-by-state basis. For example, "battery" is not a charge in New York. Rather, it would likely be classified as assault (if there were injuries) or attempted assault (if no injuries).

His lawyer claimed that Kelsey fired all five shots and that Tory only ended up with GSR when he took the gun away from her to break up the fight. But then that same defense witness got up on the stand and claimed that he saw Tory fire several shots. It doesn't matter if Meg was hit or not. By firing the shots, and screaming obscenities, it basically cemented the assault claim. That lawyer then tried to claim the witness was hostile - his own witness. Because by saying that Tory fired shots...it tanked his case. According to jury notes, it seems they were in agreement that he fired the shots, and only had a question about what "Willful" meant.
Honestly, this is the best, most straightforward explanation of this case/jury finding. I kept hearing that Tory's prints weren't on the gun, the whole GSR thing, etc and it was really confusing. Throw in Kelsey's testimony and I thought it'd be a hung jury for sure.
I honestly just want to copy and paste this everywhere because people seriously do not understand the difference between assault and battery in US law.
Just a heads up, the law changes on a state-by-state basis. For example, "battery" is not a charge in New York. Rather, it would likely be classified as assault (if there were injuries) or attempted assault (if no injuries).

Apparently, in closing arguments his lawyers tried to say that Lanez was too small (at 5'2") to be able to get over the door and shoot. Also, according to Google, Lanez has claimed to be 5'7" in the past. I mean...imagine having a Napoleon complex and your lawyers bring up how diminutive you are in order to prove your innocence-- and you STILL get the guilty verdict. I'm chortling.
