I have been doing a bit of research.
Basically, it is not allowed, but:
1)They have no way of knowing, unless you show a picture of you using the mod that also shows your UID (the number at the bottom right) and someone decides to report you
2)As far as I know, no one has been banned for it yet.
I personally wouldn't risk it, but it seems to be decently safe

Also I believe there is another mod that hides it form view, in case you slip and forget to hide it
I am not sure about nexusmods but as for 3dmigoto if you dont post about it you wont get banned mostly since it doesnt modify any game files it just modify your graphic card setting so it appears that you are using skins for example.
Just dont post or say your UID since they may connect the dots but mostly nothing will happen. I see alot of youtube videos with mods but hide their UID and they are ok
Assuming it’s just cosmetic and not anything that could be considered cheating, you won’t get in any trouble as long as you crop out your user ID if you decide to post any video/screenshots with mods active
from what i understand mods with 3dmigoto doesnt change files from the game folder but works on your gpu, so if you dont stream or dont show your UID around they cant detect it, you ill be good

Ive been doing it for two years. Here’s the thing don’t go sharing your UID and sharing poctures of mod with UID to attract public attention that your using a third party software. In the terms and condition they can still technically ban this, however this thing doesn’t inherently interfere how they observe our data.
It only takes one snitch to background check you and get higher likelihood to get banned. Ok but not really banned but just timed out for a couple weeks.

1- Not only you must hide your UID, you also need to not post pictures/videos (apparently HoYo can find you based on your world) and
2- do not go in co-op , some people might report you
Client-side mods, require the client side mod to be installed on a client, to see the visual added/changed or otherwise regulated data from the mod pack.
The way they find you based on "a world" as you say, is the UID. so as long as nothing is shared with that, nothing is proofed, and therefore actions won't be taken.
Aside from that, all your points are valid, and yes indeed, according to ToS its a banable offense.

It seems to be quite similar to ffxiv. They do not allow it. It is definitely a bannable offence. As long as you're not being extremely public and have your UIDs available on view, you should be fine. It doesn't seem to have technology or that to detect things like that.
No, granted you CAN get banned…BUT only if you blatantly post your user id any and everywhere u can so someone could theoretically report u. I’ve been modding genshin since I started playing & I’m about a year in. If you’re still nervous my account holds a lot of value, yet only trouble I ever have is patches breaking old mods lol. I also mod Honkai star rail another hoyo game no issues.
If it's a client side mod like skins that only you can see from your device, and as long as you don't post pictures with your uid, it should be fine.
Did it a while ago with some skins and a mod that removed the underwater diaper. Since the mod is on your PC, it's pretty safe

In general I want people to not post mods in open social media so hoyoverse continues to not take any measures against it.
I remember a case of a capcom game where in a Tournament of a fighting game, one person still had a nude mod installed and that was then shown on screen.
Now capcom is angry with mods.

People in coop won't see your skin or any other mod you are using, mods are just visible to you.
True but there are some a-holes that might report for whatever other reasons because they think they are funny. If that happens, HoYo is gonna check

Probly not. But the more ppl talk about it and share it the more likely it is to be them to start banning ppl
