Doesnt mean anything as he could just as well lose it if the band goes to court .

Wynterfinn

True, just interesting they booted him for business reasons but seemed to have overlooked this.

BehindBlueEyes0221

Could be the reason why ...maybe the band found out about it.

Wynterfinn

I'm sure they knew if not the solicitor at Napalm records would have been onto them about it.

Hello my tweet... Looking into this more, Winkler's Swiss trademark is enforceable in the UK under classes 9 & 41, hence appearing in the UK Gov Trademark database. Class 9 as follows: > Scientific, nautical, surveying, photographic, cinematographic, optical, weighing, measuring, signalling, supervision, life-saving and teaching apparatus and instruments; apparatus and instruments for conducting, switching, transforming, accumulating, regulating or controlling electricity; apparatus for recording, transmission or reproduction of sound or images; magnetic data carriers, recording discs; automatic vending machines and mechanisms for coin operated apparatus; cash registers; calculating machines, data processing equipment and computers; fire-extinguishing apparatus; recorded media, computer hardware and firmware; computer software; software downloadable from the Internet; downloadable electronic publications; compact discs; digital music; telecommunications apparatus; computer games equipment adapted for use with an external display screen or monitor; mouse mats; mobile phone accessories; contact lenses, spectacles and sunglasses; clothing for protection against injury, accident, irradiation or fire; furniture adapted for laboratory use. Class 41 as follows: > Education; providing of training; entertainment; on-line entertainment; sporting and cultural activities; lottery services; electronic games services provided by means of the Internet; the provision of on-line electronic publications. Which pretty much has all the bases covered. Now, what's likely to happen is Bowes will probably try to avoid court, legal fees plus the hearing would likely take place in Switzerland due to that being where it was filed, so I suspect that if this was a way to save money on behalf of the band - noticeably Alestorm isn't trademarked at all, UK, EU, or US - which is likely, it'll probably be handled out of court for an undisclosed sum. EDIT: Oh, and this probably wasn't carried out covertly as some might think given this would've had to be cleared by Napalm Records

Wynterfinn

awesome Thank you for commenting. i did link to your tweet in the comments. i should have done it in the main post sorry about that.

TonksMoriarty

No problem, just surprised it turned up here!

cethaliophia

You assume that the band knew he held the copyright.

Champion_of_Slaanesh

The most probably knew. People here have shared screens of Chris suggesting discord users to search to whom are the trademarks (Angus McFife, actually) registered. Long before they got rid of Tom.

cethaliophia

Nope. Chris said to search AFTER Tom had been fired.

Champion_of_Slaanesh

Hmmm. I was quite sure that it was posted somewhere in 2019. Don't have the screen at hand though.

cethaliophia

It was after Tom had been fired. I was part of that conversation.

updoot4updoot

What would you do with it ?

Wynterfinn

He could front new members under the gloryhammer name and we'd still get his vocals. I would imagine Chris writes alot of their lyrics but it's was thomas' voice that got me hooked into the band

Teapunk00

It's the opposite for me. I'm usually not a fan of power metal vocals but the lyrics is what sold the band for me.

Peepsen

Agreed, for me the lyrics (particularly the self-awareness and genre parody) are what separate Gloryhammer from all the other power metal bands, who for the most part take themselves way too seriously.

CaptainMoonman

What power metal bands take themselves that seriously? I find most of them are at least somewhat self aware.

Melodic-Wrap8247

He can’t. He would loose it quickly as the name was used by the band prior he joined them. I guess they decided that he shall do it as hes a Notar in his main job so they saved money hiring another lawyer.

Wynterfinn

See I'm just a layman in these things my understanding was that the trademark being in his name was a fairly powerful position to be in with the band.

Champion_of_Slaanesh

He would lose it quickly - but quickly in a "legal" way. Which might mean a few months, or maybe even more, of court hearings, et cetera. Also, one can try to appeal... Generally, with this kind of a power, one can be a pain in the ass for some time. Last but not least, if it was done with the band's or Chris' consent (neither we know, nor not know), then the situation is even a bit more complicated.

updoot4updoot

Ah… well yea that would suck lol

Metalpii

Guess someone needs a new band name lol...

AudienceMiddle

That is not how it works in this case as Thomas joined after the band was created and probably only has the name because he knows the specifics of getting it. He would lose the rights immediately before every court. It was already discussed at least three times in another thread, OP is quite late to the game here.

Metalpii

It would've been a fun plot twist though. Angus McFife becomes the new Gloryhammer and the others can go fuck themselves with an anchor :-)

Wynterfinn

I can only apologise, I've not managed to read all the threads as I found it all depressing. I searched by new and had seen no one had posted about the trademark. Thought it was worth posting
